Grand Jury hands down 33 indictments

ELKINS – An Elkins man who was charged with six counts of sexual abuse was one of 33 people indicted in Randolph County Circuit Court on Monday and Tuesday.

Lawrence Edward Davis, 40, was indicted on three counts of sexual abuse in the first degree, a felony, and three counts of sexual abuse by a parent, guardian or custodian, a felony, after West Virginia State Police officials received a complaint on Sept. 7, 2013, from a woman who advised them she had sometimes left her daughter alone with Davis between April 2011 and Aug. 4, 2013.

The woman told police her daughter “told her more recently that Mr. Davis ‘touched her down below’ two times,” according to the criminal complaint.

The girl would have been 11 at the time, the complaint states.

According to the Office of Randolph County Prosecuting Attorney Michael Parker, bond return for the grand jury indictments in the February 2014 term will be at 9 a.m. March 5. At that time, bond will be set and trial dates will be determined.

Also indicted by the grand jury:

Michael Reginald Anacker, 54, an inmate of Tygart Valley Regional Jail was indicted on 13 counts of possession of material depicting a minor engaged in sexually explicit conduct, a felony.

Anacker was arrested after an investigation led authorities to believe he was downloading the materials on an Elkins Public Library computer on Aug. 1, 2013.

Davis Allan Arbogast, 33, of Valley Bend, was indicted on one count of burglary, a felony, and one count of petit larceny, a misdemeanor.

Arbogast was arrested for allegedly breaking and entering into the residence of Jerry Lee Bender Jr. and stealing an orange Stihl MS 311 chainsaw, worth $500 on July 22 and 23, 2013.

Nathaniel William Bragg, 23, an inmate of Tygart Valley Regional Jail, was indicted on one count of receiving or disposing of stolen property and one count of possession of a stolen vehicle, both felonies.

Jonathan David Cochran, 19, an inmate of the Tygart Valley Regional Jail, and Cameron Paul Loudin, 20, of Ellamore, were each indicted on one count of burglary, a felony, one count of grand larceny, and two counts of conspiracy, both felonies.

Both Cochran and Loudin were arrested after allegedly breaking into the home of Sturl Waybright and stealing items worth $1,350 in October 2013.

Devin Wade Cook, 24, of Elkins, was indicted on one count of burglary, one count of grand larceny, one count of conspiracy to commit burglary, and one count of conspiracy to commit grand larceny, all felonies.

Cook was arrested after allegedly stealing items worth more than $1,000 from the residence of Larry Cook in October 2013.

Cook also was indicted, in a separate and unrelated case, along with Markie Leeann Jefferies, 26, of Montrose on one count of burglary, one count of conspiracy, both felonies, one count of petit larceny and one count of conspiracy to commit petit larceny, both misdemeanors.

Jefferies and Cook were arrested after allegedly breaking into the residence of Wilma Leary and taking more than $300 worth of property.

Gary Duane Cool, 30, of Monterville, was indicted on one count of driving while his dirver’s license was revoked for DUI, third offense, a felony and one count of giving false information to a member of the Department of Public Safety, a misdemeanor.

Loretta Deborah DeShayes, of Elkins, was indicted on one count of shoplifting, third offense, a felony.

Nathan Joel Fields, 33, of Elkins, was indicted on one count of burglary and one count of grand larceny, both felonies.

Fields was arrested after allegedly breaking into the home of William T. Johnson and stealing items worth $3,650 in September 2013.

Larry Thomas Gainer, 38, of Buckhannon, was indicted on one count of malicious assault, a felony.

Gainer was arrested after allegedly stabbing Steven A. Guessford on Sept. 18, 2013.

Gregg Scott Haymond, 40, of Rock Cave, was indicted on two counts of failure to register as a sexual offender or provide notice of registration changes, a felony.

James Edman Hoskinson, 48, of Dailey, was indicted on one count of driving under the influence, third or subsequent offense, a felony and one count of driving revoked for DUI, a misdemeanor.

Junior Christopher Howell, 40, of Dailey, was indicted on one count of manufacturing a controlled substance, a felony.

Howell was arrested on July 26, 2013, for allegedly growing marijuana.

Jared Michael Iseli, 20, of Beverly, was indicted on two counts of sexual assault in the first degree, a felony.

Iseli was arrested after allegedly having sexual intercourse with an 11-year-old girl on two occasions.

Niketa Elaine Lanham, 29, of Mill Creek, was indicted on one count of shoplifting, third offense, a felony.

Justin Kail Liedy, 34, of Beverly, was indicted on four counts of failure to register as a sexual offender or provide notice of registration changes, a felony.

Timothy Adam Marshall, 26, of Elkins, was indicted on two counts of wanton endangerment involving a firearm, a felony, one count of carrying a concealed deadly weapon without a license, one count of obstructing a police officer and one count of public intoxication, all misdemeanor.

Marshall was arrested after an incident at Lexy’s Bar, where he allegedly pulled a gun on James Shockey on Aug. 25, 2013.

Daniel Clifford Moore, 26, of Elkins, was indicted on three counts of child abuse resulting in bodily injury, a felony.

Moore was arrested after allegedly inflicting wounds on a four-year-old victim in November 2013. The criminal complaint indicated the alleged victim had gone to school with visible bruises and injuries to her face and neck area on Nov. 4, 2013.

Kimberley Rochelle Nicholson, 22, of Belington, was indicted on one count of possession of a controlled substance by fraud, one count of uttering and one count of conspiracy to possess a controlled substance by fraud, all felonies.

Nicholson was arrested after allegedly forging prescriptions with a false signature of Dr. William A. San Pablo for oxycodone in April 2013.

Raynard Trent Parrack Sr., 49, of Huttonsville, was indicted on two counts of sexual assault in the first degree, one count of displaying obscene matter to a minor and one count of use of obscene material with intent to seduce a minor, all felonies.

Parrack was arrested for allegedly engaging in sexual intercourse and sexual intrusion with a 4-year-old victim in November 2013 and for allegedly showing a pornographic video to a minor in July 2005.

Tony Boyd Pennington, 19, of Whitmer, was indicted on one count of burglary, a felony and one count of petit larceny, a misdemeanor.

Pennington was arrested after allegedly breaking into the home of Mary Ruth Elza and allegedly stealing six prescription medications.

Jeremy Allan Roberts, 40, of Elkins, was indicted on 14 counts of possession of precursor with the intent to manufacture methamphetamine and one count of conspiracy, both felonies.

Roberts was arrested after allegedly buying materials to make methamphetamine between December 2012 and August 2013 and for allegedly conspiring with others to manufacture the drug.

Christopher Michael Rosier, 27, of Elkins, was indicted on one count of child abuse resulting in serious bodily injury and one count of malicious assault, both felonies.

Rosier was arrested after an incident in August 2013 where he allegedly left a 17-month-old infant unattended in a bath tub “for about three minutes” to tend to another child, and returned to find the alleged victim was “face down in the water with her head under the faucet,” according to the criminal complaint. Medical officials later found multiple injuries that “include but are not limited to multiple skull fractures, retinal hemorrhaging in both eyes, multiple bruises on the body and face, and a fracture to the left humorous bone that was already in the healing stages.”

Debora Lee Rowback, 26, of Elkins, was indicted on one count of possession with the intent to deliver a controlled substance (marijuana), a felony.

Ann Marie See, 21, of Elkins, was indicted on four counts of forgery and four counts of uttering, both felonies.

Justen William Shomo, 23, of Elkins, was indicted on one count of grand larceny, one count of breaking and entering, both felonies, and one count of destruction of property, a misdemeanor.

Shomo was arrested after allegedly stealing and damaging a 2006 Honda Foreman 200 all-terrain vehicle belonging to Christopher Rhodes.

Michelle Renee Skidmore, 42, of Belington, was indicted on seven counts of forgery, one count of uttering, one count of possession of a controlled substance (Alprazolam) and one count of conspiracy to possess a controlled substance by fraud, all felonies.

Skidmore was arrested after allegedly forging prescriptions with the signature of Dr. William San Pablo from March 2012 to February 2013.

Robert Michael Sparks, 32, of Huttonsville, was indicted on one count of driving while license revoked for DUI, third offense, a felony, and one count of obstructing an officer, a misdemeanor.

Erik James Wesoloski 46, of Elkins, and Randy Kim Kinzy, 32, of Elkins were each indicted on one count of fraudulent schemes and one count of conspiracy, both felonies.

Sparks and Wesoloski were arrested after allegedly plotting to unlawfully obtain approximately $2,800 worth of merchandise from the Elkins Kmart in October 2013.

James Wilson Falls III, 27, an inmate of Tygart Valley Regional Jail, was indicted on one count of malicious assault, one count of burglary, one count of attempted malicious assault upon an officer and one count of retaliation against a public official or employee, all felonies.

Falls was arrested after allegedly unlawfully entering the residence of Matthew D. Ray and stabbing him in November 2013.

The fact that a defendant has been charged with a crime is merely an accusation and all defendants are presumed innocent until and unless proven guilty.
