Buckhannon man facing felony charge

BUCKHANNNON – A Buckhannon man was arrested Wednesday for allegedly driving while his license was revoked for DUI.

Frank A. Harvey, 50, remained incarcerated in the Tygart Valley Regional Jail Thursday after being charged with one felony count of driving while revoked for DUI, third offense, and one misdemeanor count of no

insurance.

According to the criminal complaint in the Upshur County Magistrate Clerk’s office, Senior Trooper Victor Pyles was traveling south on Brushy Fork Road when he spotted a green Ford pick-up truck, which was also traveling south. Pyles could not decipher the registration tag on the vehicle “due to a large ball hitch and snow,” so he pulled Harvey over at Brushy Fork Mart, the complaint states.

Harvey provided Pyles with a West Virginia identification card and allegedly told the officer that his license was suspended.

Upon consulting with the WVSP Elkins Detachment Communications Center, Pyles learned that Harvey’s license had been revoked for DUI, the complaint states. When Pyles asked Harvey for his insurance card, Harvey could not provide one, according to the report. Pyles then placed Harvey in custody and transported him to the Buckhannon detachment of the WVSP, where he learned that Harvey had been convicted of driving revoked for DUI on July 13, 2004; July 7, 2009; and also had an “active driving while revoked DUI” on Aug. 18, 2009, according to the criminal complaint.

Pyles was also allegedly informed about a conviction on Jan. 14, 2010, the complaint states.

Magistrate Mike Coffman set bond at $25,000, and Harvey remained in the TVRJ as of presstime.

The penalty for a conviction of driving while revoked for DUI is confinement in a state penitentiary for one to three years and a fine ranging between $3,000 and $5,000.

The penalty for a conviction of no insurance is confinement in a regional jail for 15 days to one year and/or a fine ranging between $200 and $5,000.
