Upshur man charged with sexual assault
BUCKHANNNON – A 19-year-old Buckhannon man is being held on a $75,000 bond after being arrested Monday on charges of allegedly sexually assaulting a 12-year-old female in January.
Damion Tyler Cobb was charged with one felony count of sexual assault in the third degree, an allegation that stems from an alleged Jan. 16 incident involving a 12-year-female victim who reportedly told police he was her boyfriend.
According to the criminal complaint in the Upshur County Magistrate Clerk’s office, Cpl. B.K. Wright of the Buckhannon detachment of the West Virginia State Police received a sexual abuse complaint from the alleged victim on Jan. 18.
“The victim supplied information of the day and time in question and stated the suspect was her so called (sic) boyfriend,” Wright wrote in the report.

The alleged victim said Cobb allegedly “stopped when she instructed him to,” but then asked her if she wanted to touch his genital area, to which she replied no. Cobb then allegedly “grabbed her hand and stuck her hand down his pants,” forcing her to touch his genitalia, the complaint states.
The police report notes that Wright, the investigating officer, traveled to the Upshur County School bus garage on Feb. 7 to view surveillance footage, which allegedly corroborated the alleged victim’s account of events. The complaint does not explicitly state whether the incident took place on an Upshur County school bus, and West Virginia State Police officials were unavailable to comment as of presstime.
In a Feb. 23 statement, Cobb confirmed the alleged victim’s statement, the complaint notes.
Sexual assault in the third degree occurs when a person age 16 or older engages in sexual intercourse or “sexual intrusion” with another person who is less than 16 years old and who is at least four years younger than the accused person, according to state code.
As of presstime, Cobb remained in the Tygart Valley Regional Jail on a $75,000 bond set by Magistrate Juanita Adams.
The penalty for conviction of third-degree sexual assault in imprisonment in a state penitentiary for one to five years, a fine up to $10,000 or both.
