ABU student appears in court

BUCKHANNON – An Alderson Broaddus University student who was arrested in connection with a group assault was arraigned in Upshur County Circuit Court Monday following his grand jury indictment last week.

Steven Roderick Smith, 19, of Virginia Beach, Va., pleaded not guilty to one felony count of unlawful assault. He is alleged to have stabbed a West Virginia Wesleyan College student during an altercation on March 23 in Buckhannon when Dalton Tyler, a WVWC student, allegedly was stabbed.

Kurt Hall, 26th Judicial Circuit Court judge, ruled that Smith have no contact with the alleged victim and that he not be on West Virginia Wesleyan College property. Because Smith lives in Virginia, Hall also ruled that he be permitted to leave the state.

Others indicted by Upshur County grand jury also were arraigned in court Monday.

– Travis Wade Frame, 43, of Rock Cave, pleaded not guilty to two separate indictments, but he was taken into custody and his arraignment was rescheduled after he tested positive for bu-morphine, methamphetamine and amphetamine in a urine test taken just after his arraignment.

His bail was revoked, and he will have to enter a plea to his charges at a later date. Hall said he wanted to be sure Frame could think clearly and was not under the influence when he entered his plea. His arraignment is now scheduled for 1 p.m. Thursday.

Frame’s charges for one indictment include operating or attempting to operate a clandestine drug lab, a felony, possession of a precursor used to manufacture methamphetamine, a felony, and two counts of conspiracy, also felonies. In a second indictment, Frame also is charged with delivery of a controlled substance, a felony, and delivery of a controlled substance within 1,000 feet of a school, also a felony.

– Dereck Adam Cobb, 23, of Buckhannon, did not appear in court for his indictment on three felony counts of delivery of a controlled substance. A capias was issued for his arrest, and his arraignment will be rescheduled.

– Robert Nicholson Poling, 73, of Adrian, also did not appear in court for his arraignment on one felony count of failure to provide notice of change in sex offender registry information. Prosecuting Attorney Jake Reger said Poling was notified of the arraignment through a letter sent to his last known address. A capias was issued.

– John Ellis Frame, 40, of Rock Cave pleaded not guilty to one felony count of operating or attempting to operate a clandestine drug laboratory.

– Terry Lee Duke, 29, of Buckhannon, pleaded not guilty to operating or attempting to operate a clandestine drug laboratory and conspiracy, both felonies.

– Sandra Marie Williams, 34, of St. Albans, pleaded not guilty to operating or attempting to operate a clandestine drug laboratory and conspiracy, both felonies.

– Sydney King, 20, of Buckhannon, pleaded not guilty to three felony counts of delivery of a controlled substance, heroin, and waived her right to a speedy trial.

– Steven Todd Arnold, 24, of Buckhannon, pleaded not guilty to one felony count of grand larceny.

– Robert James Adams, 26, of Kingwood, pleaded not guilty to one felony count of driving while license revoked for DUI, third or subsequent offense.

  • Terry Linn Norman, 56, of Buckhannon, pleaded not guilty to two felony counts of failure to provide notice of change in sex offender registry information. Norman’s bond was set at $2,500 cash or surety.
  • Alicia Chantell Zinn, 26, of Volga, pleaded not guilty to grand larceny, a felony, one count of conspiracy, a felony, two counts of conspiracy, misdemeanors, and two misdemeanor counts of petit larceny.
  • James Alan Linville Jr., 30, of Charleston, pleaded not guilty to one felony count of grand larceny and one misdemeanor count of petit larceny.
  • Frank A. Harvey, 36, of Buckhannon, pleaded not guilty to two separate indictments, each one including a separate felony count of driving while license revoked for DUI, third or subsequent offense. Hall ruled that Harvey not be permitted to operate a motor vehicle and ordered that he be placed on home confinement.
  • David Wallis Sites III, 34, of Buckhannon, pleaded not guilty to one felony count of grand larceny.
  • Deborah Ball, 42, of Bridgeport, pleaded not guilty to one felony count of embezzlement. Hall ordered she not enter any 7-Eleven stores.
  • Michael R. Long, 24, of Rock Cave, pleaded not guilty to burglary, breaking and entering and grand larceny, all felonies. He also pleaded not guilty to a second indictment for grand larceny. Long was placed on bond supervision and his attorney, David Orndorff of Buckhannon, notified the court that Long is living in Virginia. Hall permitted him to leave the state, but ordered that he be drug tested on a weekly basis because he tested positive for marijuana Monday.
  • Zachary Scott Shreve, 23, of Reedsville, pleaded not guilty to one felony count of malicious assault.
  • Jedadia Stump, 27, of Buckhannon, pleaded not guilty to domestic battery, third or subsequent offense, malicious assault and escape, all felonies.
  • David L. Stewart, 50, of Buckhannon, pleaded not guilty to one felony count of failure to provide notice of change in sex offender registry information.
  • Lloyd R. Nicholson, 29, of Buckhannon pleaded not guilty to one felony count of failure to provide notice of change in sex offender registry information, a felony.

All individuals are presumed innocent until and unless proven otherwise in a court of law. For all those indicted above who also appeared in court, jury selection was set for August 18, which may be followed by a trial within three weeks of that date. Pretrial hearings will be scheduled on either August 11 or 12.
