Man charged with burglary

ELKINS – An Elkins man is being housed at the Tygart Valley Regional Jail on a $25,000 cash only bond after allegedly entering residences in Norton.

Timothy Lee Arbogast, 39, of Elkins, is charged with one felony count of daytime burglary, one misdemeanor count of disorderly conduct and one misdemeanor count of domestic battery.

According to the criminal complaint, Sr. Trooper J.J. Cornelius of the West Virginia State Police responded to a Norton residence in response to a burglary complaint on June 9.

The alleged victim said, in a handwritten statement, that someone had “entered her residence, spilling clothes and put a coke (sic) in the freezer,” and that someone had “urinated in the toilet.”

The woman added a construction worker had observed someone enter her residence. She also stated she was “unsure if anything was taken, however, she is missing a house cat,” according to the complaint.

Later that afternoon, Cornelius spoke with the construction worker, who said he “saw a man attempt to enter a white in color house and then enter the victim’s residence,” and he described the man as “skinny and short, wearing a white in color T-shirt.”

After talking with the construction worker, Cornelius recovered a debit card from the roadway that the alleged victim said belonged to her husband. Cornelius also recovered an “orange in color sweatshirt and a white in color plastic bag from the white in color residence neighboring the victim’s residence.” The homeowner said those items did not belong to him.

Cornelius had encountered Arbogast the morning of the same day in Norton, before receiving the call from the victim, and said at that time Arbogast was “wearing an orange in color sweatshirt and carrying a white in color plastic bag, matching the items left

on the porch,” according to the complaint.

Police said Randolph County 911 received five calls and the West Virginia State Police received five calls with “most calls referencing Mr. Arbogast was in the area, walking to residences on private property and disturbing the residences in the area.” Many of the callers also stated that Arbogast was “staggering in the street,” according to the complaint.
