Elkins man arrested on felony charge

ELKINS – An Elkins man is behind bars and accused of failing to update required information as a registered sexual offender.

Timothy Allen Scott, 37, is charged with one felony count of failure to register as a sexual offender, second offense. Bond was set at $10,000 cash or surety by Randolph County Magistrate Rob Elbon.

According to the criminal complaint, on July 24, Scott appeared at the Elkins detachment of the West Virginia State Police to update his sexual offender registry information. Scott reportedly told police he had “moved out of the 206 Davis Street Apt #2B Elkins, WV address and was now living at 3061st Street Apt #5 Elkins, WV,” and also that “this change was as of this date.”

On July 28, Cpl. S.P. Miller of the State Police arrived at the 1st St. address and spoke with the tenant who was renting the apartment. According to the complaint, the tenant advised Miller that “she was familiar with the above named defendant (Scott) and that he had stayed the night on July 24, but that she told him he could not live with her.” She said she last saw Scott “leaving her apartment the next morning carrying his bag of clothes.”

Scott failed to notify the State Police of this incorrect information within 10 business days as required and was arrested on Aug. 11 for a probation violation, according to the complaint.

Scott has a prior conviction for failure to register as a sex offender dated April 15, 2010, in Barbour County.
