Sentences handed down in Upshur Circuit Court
BUCKHANNON — A number of sentencings occurred Friday in Upshur County Circuit Court, including a man who was accused of selling drugs near a school.
Christopher Fayne Yost, 43, and Aimee Redden, 37, both of 65 Circle Dr., Mount Claire, were arrested in March on warrants obtained by Lt. Douglas Loudin of the Buckhannon Police Department. Each was charged with a felony count of delivering a controlled substance within 1,000 feet of a school, according to previously filed criminal complaints in Upshur County Magistrate Court.
Yost allegedly sold 10 Percocets to a confidential informant in exchange for $100, according to the complaint filed in March. The transaction allegedly took place within 1,000 feet of Head Start on Cleveland Avenue.
Redden allegedly sold 1 gram of methamphetamine and a “dime bag” of marijuana to a confidential informant in exchange for $100, also within 1,000 feet of Head Start.
Both incidents allegedly occurred in December, according to the complaints.
On Aug. 11, Yost pleaded guilty to a felony count of delivering a controlled substance within 1,000 feet of a school, with any additional charges against him being dismissed on Friday. He was sentenced to one to five years in the state penitentiary, which was suspended in favor of five years probation, 54 days jail time with 54 days credit for time served, and he will be subject to drug screenings.
Cindy Hamilton, 43, of Tallmansville, was indicted in May on one count of conspiracy, a felony; one count of fraudulent schemes, a felony; two counts of forgery, a felony; and two counts of uttering, a felony. On Aug. 30, Hamilton pleaded guilty to uttering, a felony, and, Friday, she was sentenced to one to 10 years in the state penitentiary.
The sentence was suspended in favor of five years of probation, and all other charges were dismissed.
Devan W. Rhodes, 28, French Creek, was indicted in January for one felony count of daytime burglary and one misdemeanor count of petit larceny. On April 8, Rhodes plead guilty to daytime burglary, a felony, and on Friday, was sentenced to one to 15 years in the state penitentiary with credit for the 73 days he has already served.
A request for alternative sentencing was denied, and county two of the indictment was dismissed.
Christopher Acres, 28, of Buckhannon, was indicted in May on one count of fraudulent use of an access device, a felony. Acres failed to appear to his court date, and there is a capias for his arrest.
