Bond modified in felony case

ELKINS — A Belington man accused of stealing a trailer and a side by side utility vehicle had his bond modified in Randolph County Magistrate Court.

The bond for Micheal David Nine, 32, was modified from $50,000 cash-only to $25,000 cash or surety by Randolph County Chief Magistrate Rob Elbon.

He is charged with one felony count of breaking and entering, one felony count of grand larceny and one felony count of conspiracy.

Additionally, Nine waived his preliminary hearing, meaning the case will be bound over to the Randolph County Circuit Court for presentation to a grand jury.

Randolph County Assistant Prosecuting Attorney Leckta Poling represented the state while Nine appeared with Brian Bailey as defense counsel. Elbon presided.

According to a criminal complaint filed in Randolph County Magistrate Court, on Nov. 16, Cpl. S.P. Miller, of the West Virginia State Police, responded to Nine’s residence regarding a theft complaint from Asplundh Tree Services.

Officials with the company reportedly said a side by side had been stolen but it had a GPS tracker on it. They added the coordinates showed it to be at Nine’s address.

Once on scene, Miller found an aluminum single axle trailer, with no registration on it, hooked to a 1999 blue Jeep Wrangler. Miller requested that Elkins Communications contact Elkins Motor Sports to see if the trailer was theirs, according to the complaint. Officials with Elkins Motor Sports said the trailer belonged to the company and it had been stolen.

On Feb. 1, Miller obtained video surveillance of a vehicle matching Nine’s Jeep driving by Elkins Motor Sports, along the Beverly Five-lane, on Nov. 16, the complaint states.

Miller also saw, on the video, two male individuals forcing a side door open and removing items from a building at the business. The males were identified as Nine and Allen Kirkpatrick, both of whom were arrested in Barbour County for possessing the stolen property, according to the complaint.

Elkins Motor Sports said the value of the trailer was $3,200, police said.

Miller spoke with Kirkpatrick, who said he and Nine traveled to Elkins to steal the items, the complaint states.
