Belington man pleads guilty to trespassing

ELKINS — A Barbour County man who was found in the residence of an Elkins woman entered into a plea agreement in Randolph County Magistrate Court.

Christopher Don Bibey, 34, of Belington, pleaded guilty to one misdemeanor count of trespassing as part of the plea agreement. The prosecution dismissed the original charge of one felony count of nighttime burglary.

Randolph County Assistant Prosecuting Attorney Leckta Poling represented the state while Bibey appeared with James E. Hawkins Jr. as defense counsel. Randolph County Magistrate Rob Elbon presided.

According to a criminal complaint filed in Randolph County Magistrate Court, on Jan. 23, Elkins Police Department Cpl. M.J. Sigley was advised by E-911 Communications to contact a female individual regarding a man being inside her residence when she came home.

Sigley spoke to the victim over the phone and instructed her to come to the Elkins Police Department in order to provide a statement.

In her statement, the woman said she returned to her residence on Harrison Avenue in Elkins at approximately 6:30 a.m. and found Bibey inside the home. She added he “did not have any business there,” the complaint states.

The victim asked Bibey “why he was in her house,” at which time he “grabbed a backpack and took off.”

The victim said Bibey had her “old Harley-Davidson model bike bagged up,” but left it behind when she approached him.

She added she did not know how Bibey got into the residence and said she had spent the previous night in Davis, according to the complaint.
