Upshur man facing drugs, gun charges
BUCKHANNON — A “be on the lookout” notification transmitted on police radios led to a Buckhannon man being arrested on the charge of possession of a controlled substance and a firearm, officials said.
John David Humphrey, 38, is facing a felony charge for possession of a controlled substance with intent to deliver and a misdemeanor charge for being a prohibited person possessing a firearm.
According to the criminal complaint, on June 13, Cpl. Rocky Hebb and Cpl Theron Caynor of the Upshur County Sheriff Department located a Jeep Grand Cherokee with front end damage pulled into a driveway of a residence along Stone Run Road. Deputies had been alerted via police scanners to be on the lookout for the vehicle due to suspicious activity in the Family Dollar parking lot.
Upon approaching the vehicle, Hebb found Humphrey to be “extremely nervous,” the complaint states. In the back seat, the deputy saw two small children with a .243 Savage Arms rifle between them, reads the police report.
Hebb asked Humphrey if there was anything in the vehicle that shouldn’t be there. Humphrey said “he had weed and that should be it,” according to the police statement.
Hebb requested that law enforcement search the vehicle, which Humphrey gave verbal consent to do, reads the report. Upon searching the vehicle, the clip to the gun with two shells within it was located in the console. Two baggies containing a total of 3.1 grams of meth was also found in the vehicle.
The police report also states that several empty small baggies and a set of digital scales were found during the search, along with a small baggy of marijuana.
According to the criminal complaint, Humphrey confessed to Hebb that the drugs were his and he had just done a line of meth the night before.
Humphrey said he had the gun for he and his children’s protection because he believed people were after him, reads the police report.
The criminal complaint notes that Humphrey has had previous drug charges with conviction dates of March 22, 2010, and September 17, 2015.
