Randolph grand jury hands down 34 indictments

ELKINS — A Randolph County man accused of having inappropriate contact with two children in his care was among individuals named in 34 indictments handed down Monday by a Randolph County grand jury.

Antoine Stevens Johnson, 42, of Elkins, was indicted on two felony counts of sexual abuse in the first degree and one felony count of sexual abuse by a parent, guardian, custodian, or person in a position of trust to a child.

According to a criminal complaint filed in Randolph County Magistrate Court, on May 10, Patrolman W.D. Butcher and Cpl. A.M. Wyshyvanuk, both of the Elkins Police Department, received a written complaint from a female regarding an alleged sexual assault against two of her granddaughters — a 6-year-old and a 9-year-old.

The woman said on April 13, the 6-year-old told her that “Diamond” — which is what they called Johnson — had touched her. When asked where on her body she was touched, the girl began to cry and wouldn’t say, according to the criminal complaint.

The grandmother of the alleged victim reportedly said she took both girls to a local general practitioner to be evaluated and an interview was scheduled with both juveniles at the Randolph-Tucker Children’s Advocacy Center. The 6-year-old did not confirm any inappropriate activity by Johnson but “did appear to physically and verbally shut down,” according to the criminal complaint.

The 9-year-old said that after the girls took showers, Johnson would brush their hair, at which point he became aroused. She added that Johnson would also pull down their pants and underwear, the complaint states.

The 9-year-old said it only happened one time but she thinks Johnson “is doing or has done it to her sister.” She added Johnson “placed his private parts in hers” and her sister had told her “he played with me,” court documents indicate.

Other indictments handed down Monday include:

• James Thomas Miller, 38, of Montrose, was indicted on two felony counts of sexual abuse in the first and one felony count of sexual abuse by a parent, guardian, custodian or person in a position of trust to a child.

• James Edward Hoffman, 23, of Beverly, was indicted on one felony count of imposition of sexual acts on an incarcerated person and three misdemeanor counts of indecent exposure.

• Angela Shiral Hartley, 31, of Beverly, was indicted on one felony count of child abuse resulting in injury and two misdemeanor counts of domestic battery.

• Breanna Arlene Radcliff, 31, of Elkins, was indicted on one felony count of child neglect creating risk of serious bodily injury or death, one felony count of possession with intent to deliver a controlled substance and one misdemeanor count of fleeing from an officer by any means other than the use of a vehicle.

In a separate and unrelated indictment, Radcliff was indicted on one felony count of shoplifting, third offense.

• Ashley Nicole Nielson, 31, of Montrose, was indicted on one felony count of child neglect resulting in bodily injury and one misdemeanor count of child neglect creating risk of injury.

• Dillon Richard Perez, 34, of Elkins, was indicted on one felony count of child neglect creating risk of serious bodily injury or death.

• Tristan David Rosier, 29, of Elkins, was indicted on three felony counts of wanton endangerment involving a firearm.

• Marty Ray Price, 36, of Elkins, was indicted on one felony count of arson in the first degree, one felony count of arson in the third degree, one misdemeanor count of destruction of property and one misdemeanor count of violation of a protective order.

• Deven Lovell Smith, 31, of Beverly, was indicted on four felony counts of burglary, one felony count of attempted burglary and two misdemeanor counts of petit larceny.

• David Louis Deshayes, 37, of Elkins, was indicted on one felony count of delivery of a controlled substance, two felony counts of possession with intent to deliver a controlled substance and one misdemeanor count of knowingly keeping or maintaining a dwelling, building, or other structure or place for the purpose of using or selling controlled substances.

• Justin Matthew Ball, 36, of Montrose, was indicted on one felony count of delivery of a controlled substance.

• Robert Michael Sparks, 37, of Huttonsville, was indicted on one felony count of delivery of a controlled substance.

• Aaron Carl Cale, 25, of Elkins, was indicted on one felony count of possession with intent to deliver a controlled substance and one felony count of possession by prohibited person of a firearm.

• Shanna Marie Arman, 38, of Harman, was indicted on three felony counts of possession with intent to deliver a controlled substance and one felony count of conspiracy.

• Michael Shane White, 37, of Moorefield, was indicted on one felony count of possession with intent to deliver a controlled substance and one felony count of conspiracy.

• Michael Brooks Ketterman, 31, of Elkins, was indicted on one felony count of possession with intent to deliver a controlled substance and one misdemeanor count of fleeing from an officer by any means other than the use of a vehicle.

• Melissa Elaine Caprio, 29, of Elkins, was indicted on one felony count of possession with intent to deliver a controlled substance and one misdemeanor count of knowingly keeping or maintaining a dwelling, building, or other structure or place for the purpose of using or selling controlled substances.

• Jennifer Lea Howell, 33, of Montrose, was indicted on three felony counts of possession of a controlled substance by inmate.

• William Franklin McCauley, 36, of Elkins, was indicted on one felony count of transportation of controlled substances onto the grounds of a correctional facility and one felony count of possession of a controlled substance by inmate.

• Juwuan Akil Watts, 24, of Huttonsville, was indicted on one felony count of malicious assault upon a governmental representative and one felony count of offense committed by inmate.

• David Allen Welch, 20, of Valley Head, was indicted on one felony count of burglary.

• Thomas Corey Miller, 26, of Elkins, was indicted on one felony count of grand larceny, one felony count of possession of a stolen vehicle and one misdemeanor count of improper registration.

• Jesse Wade Himes, 54, of Elkins, was indicted on four felony counts of failure to register as a sexual offender or provide notice of registration changes.

• Jessica Nicol Poe, 29, of Elkins, was indicted on two felony counts of failure to register as a person convicted of child abuse or neglect or provide notice of registration changes, second or subsequent offense.

• James Floyd Loane, 52, of Sutton, was indicted on one felony count of driving under the influence of alcohol or with a BAC of .08 or higher, third or subsequent offense.

• Gary Duane Cool, 34, of Valley Head, was indicted on one felony count of driving while license revoked for DUI, third offense, two misdemeanor counts of possession of a controlled substance and one misdemeanor count of failure to stop at a posted stop sign.

• Misty Dawn Armstong, 39, of Huttonsville, was indicted on one felony count of shoplifting, third offense.

• Brittany Rae Cave, 32, of Mill Creek, was indicted on one felony count of shoplifting, third offense.

• Bradley David Shifflett, 37, of Elkins, was indicted on one felony count of shoplifting, third offense.

In a separate and unrelated indictment, Shifflett was indicted on one felony count of shoplifting, third offense.

• Kristin Michelle Gillette, 30, of Elkins, was indicted on one felony count of shoplifting, third offense, and one misdemeanor count of false information.

• Michael David Nine, 34, of Elkins, was indicted on one felony count of failure to appear.

The cases were presented by Prosecuting Attorney Michael Parker. Circuit Judge David Wilmoth presided.

Bond return hearings will be at 9 a.m. on Nov. 5 at the Randolph County Circuit Courtroom.

An indictment is merely an accusation. All defendants are presumed innocent until and unless proven guilty.
