14 Indicted In Randolph
Man Accused of Robbing Couple Among Those Facing ChargesBy BEN SIMMONS, Staff Writer
An Elkins man accused of tying up an elderly couple and robbing their home in June was indicted by a Randolph County grand jury Monday. Thirteen other individuals also face charges following the session.
Jeremy A. Pennington, 28, of Lot 59 Heavner Acres, Elkins, was indicted on four felony charges including one count each of first-degree robbery and assault during the commission of a felony, along with two counts of kidnapping.
According to the indictment, Pennington is accused of entering the home of John and Nancy Martin by fraudulent means on June 18. He is accused of violently striking John Martin in the face causing bruising and bleeding, and then telling the Martins that he had a gun. He allegedly instructed them to lie on a bed where he bound their feet and hands. Pennington then unlawfully took about $620 in cash.
Justin Nesbitt, 23, and Chasity D. Flesher, 24, both of Lot 3 Valley View MPH, Valley Bend, were indicted on multiple counts of child abuse and neglect.
Nesbitt was charged with 11 felonies including three counts of first-degree sexual assault, three counts of sexual abuse by a parent or guardian, three counts of child neglect creating risk of injury and two counts of child abuse resulting in bodily injury.
Flesher was charged with six felonies including three counts of child neglect causing risk of injury and two counts of child abuse resulting in bodily injury.
According to the indictment, Nesbitt is accused of having intercourse with two children ages 7 and 3 who were under his care and custody. He is also accused of striking both children on the buttocks with a board resulting in injury.
According to the indictment, Flesher is accused of striking one of the children on the mouth with her open hand. She is also accused of neglecting to change the diaper or apply medical ointment to the buttocks of one of the children that caused a severe diaper rash.
Both indictments also state that Nesbitt and Flesher did not have running water or a working toilet in their residence and there were buckets and sinks full of fecal material that three children could access.
Albert R. Lothes, 15 10th St., Elkins, was charged with four counts of embezzlement and one count of falsifying accounts, all felonies. According to the indictment, Lothes is accused of converting money owed to the West Virginia Wood Technology Center for his own use while employed by the company. Lothes allegedly had customers pay him directly for goods on three occasions including $6,890 for doors, $1,800 for wood trim and moldings, and $1,400 as partial payment for curly maple bookshelves. Lothes is also accused of directing a contractor to falsely add $400 to an invoice and then pay it back to him.
Jeffrey D. Ford, 36, of HC Box 61, Coalton, was indicted on one count of malicious or unlawful assault, a felony. According to the indictment, Ford is accused of striking Albert Ragazinsky "repeatedly with his fists about the face and eye causing serious injury including bleeding, bruising and a fracture" on May 8.
Penny S. Vandevender, 37, of 106 Salt Lick Road, Montrose, was indicted on one count of fraud in obtaining welfare benefits, a felony. Vandevender is accused of obtaining $5,709 in food stamps and $700 in West Virginia Clothing Allowance vouchers from August 2003 to November 2005 that she was not entitled to by withholding information from the West Virginia Department of Health and Human Resources.
Millie C. Bolyard, 30, 180 Hutton St., Huttonsville, was charged with two felony counts of false claims. According to the indictment, Bolyard is accused of making false claims to the Department of Welfare from October 2005 to March 2006 to defraud Medicaid.
Daniel A. Corica, 47, of P.O. Box 655, Elkins, was indicted on one count of possession with the intent to deliver, a felony. According to the indictment, Corica is accused of possessing four plastic Ziploc bags containing approximately 847 grams of marijuana on Nov. 28, 2006.
William R. Jones, 41, currently incarcerated at the Tygart Valley Regional Jail, was charged with one felony count each of fraudulent schemes and taking the identity of another person, along with two misdemeanor counts of fraudulent use of a credit card.
According to the indictment, Jones is accused of using the drivers license of Daniel Ehrich to rent a Chevrolet Malibu valued at $14,000 from Enterprise Rent-a-car on Jan. 5, 2007, and failed to return it. Jones is also accused of using Ehrich's credit card to purchase items at Shoe Show and Wal-Mart in Elkins.
Kathryn D. Wagner, 53, of 171 Coral Berry Drive, Martinsburg, was charged with one felony and one misdemeanor count of obtaining property in return for worthless checks on a pre-existing debt. According to the indictment, Wagner is accused of writing checks for $850 and $120 to the Ground Floor Lounge in April 2008 while knowing there were insufficient funds in the account.
Anthony E. Cogar, 45, of Route 2, Box 39, Montrose, was indicted on one count of second offense failure to register or provide notice of registration changes, a felony. According to the indictment, Cogar is accused of providing an invalid address to the state police. Cogar was not living in the home listed on the address. Instead, he was living in a van on the property, the indictment states.
Chad M. Scott, 274 Country Club Road, Elkins, was indicted on six felony counts and one misdemeanor count of obtaining property in return for worthless checks on a pre-existing debt. According to the indictment, Scott is accused of writing checks in the amounts of $1,345.12, $1,131.52, $873.76 and $1,500.96 to A.F. Wendlings Inc., $1,352.38 and $723.77 to Buzz Food Service and $50 to Mary's Maytag while allegedly knowing there were insufficient funds in the account.
Hildie M. Williams, 18, of 626 West Main St., Elkins, was charged with one count each of daytime burglary and conspiracy, both felonies. According to the indictment, Williams is accused of breaking into the home of Jay Ruediger on May 10. Williams allegedly took several items having a total value of $2,633.25.
Robert Winning, 20, currently incarcerated at the North Central Regional Jail, was charged with three counts each of forgery of a credit card and conspiracy to commit forgery of a credit card, all felonies. According to the indictment, Winning is accused of using the credit card of Robert Sturm on three occasions at McDonalds in Elkins for $9.52 and Wal-Mart for $262.88 and $196.77.
Arraignments will be at 1 p.m. Nov. 13 at the Randolph County Courthouse. All of the accused are presumed innocent until proven guilty.

Yes, it is a crime when you are a sex offender, and you are suppose to be registered. Mr. Cogar was not registered properly. Please check the WV State Police website sex offender list.
