Several Sentenced in Randolph County Circuit Court

Several individuals appeared in Randolph County Circuit Court Monday and were sentenced for various crimes.

Daniel H. Bush Jr., 35, was sentenced to one to three years in prison and fined $1,000 after pleading guilty to one count of child abuse resulting in injury, a felony.

Randolph County Circuit Judge John Henning said he would put in the sentencing order that he recommends Bush serve the full term in prison.

According to the indictment, Bush is accused of striking a 3-year-old child in his custody on Feb. 13 and holding the child's head under water in the bathtub until the child lost consciousness.

David Calain, 25, was sentenced to two years in the Tygart Valley Regional Jail after pleading guilty to two misdemeanor counts of petit larceny. He had previously made full restitution.

Calain was initially charged with one count of embezzlement, a felony. According to the indictment, Calain is accused of embezzling $1,117.98 from Radio Shack in Elkins in September 2007. According to the indictment, Calain conducted a series of transactions in which he "removed items from the store's inventory, scanned the said items with the store's computerized cash register system as returned and then issued a cash refund in the name of others," then converted said cash to his own use.

Brandon A. Sharp, 22, was sentenced to one year in the TVRJ after pleading guilty to one misdemeanor count of destruction of property. Henning suspended the sentence in favor of five years supervised probation and ordered Sharp spend every other weekend in jail. Attorney Tim Prentice represented Sharp.

Sharp was initially charged with one count of burglary, a felony, and one count of destruction of property, a misdemeanor. According to the indictment, Sharp is accused of breaking into the dwelling of Mandy Minninger in Elkins by entering through an adjoining wall and through an attic door on Feb. 14. The amount of damage is estimated at $224.80.

Rhonda Scott, 32, of 310 Diamond St., Elkins, was sentenced to one to five years in the state penitentiary after pleading guilty to one count of failure to register or provide notice of registration changes, a felony. Henning suspended the sentence in favor of five years supervised probation. Attorney Jennifer Lamora Morgan represented Scott.

Scott was initially charged with one count of failure to register or provide notice of registration changes, a felony. According to the indictment, Scott is accused of failing to register a cell phone with the West Virginia State Police Sex Offender Registry in March 2008.

Virgil T. Willis III, 40, of 210 Second St., Elkins, was sentenced to one to five years in the state penitentiary after pleading guilty to one count of failure to register or provide notice of registration changes, a felony. Henning suspended the sentence in favor of five years supervised probation and ordered Willis serve 60 days in jail.

Willis was initially charged with one count of failure to register or provide notice of registration changes, a felony. According to the indictment, Willis is accused of failing to update his change of residence with the WVSP Sex Offender Registry in October 2007.
