Upshur grand jury returns indictments

Embezzlement, child neglect causing injury, sexual assault, burglary and various drug-related offenses topped the 24 indictments handed up by the Upshur County grand jury Monday.

Gaylen Doyle Koon, Route 1 Box 3, French Creek, was indicted on eight counts of embezzlement, eight counts of grand larceny and fraudulent scheme, all felonies. According to the indictment, at various times between Jan. 12, 2008, and Oct. 13, 2008, Koon allegedly stole money and/or property totaling about $15,512 from Quick Slick Inc. in Buckhannon, which was under his care and control by virtue of his employment.

Robert Dwayne Williams, Route 4 Box 374-A, Buckhannon, was indicted for child neglect causing injury, a felony; driving under the influence of alcohol, a misdemeanor, and two counts and driving under the influence of alcohol with an unemancipated minor, a misdemeanor. According to the indictment, on June 22, Williams, while under the influence of alcohol, drove at an excessive rate of speed and subsequently wrecked a Honda all-terrain vehicle with his 5-year-old son onboard, who was not wearing a helmet.

John E. Shipman and Susanne Halterman, 161 Wood St., Buckhannon, were indicted on felony charges of grand larceny and conspiracy and misdemeanor charges of escape and conspiracy.

According to the indictment, on July 25, after allegedly having conspired to do so, Shipman and Halterman stole a 1998 Oldsmobile Achieva valued at about $3,035, while Shipman was on home confinement following a plea entered March 30 in Upshur County magistrate court.

Jessie Lee Heater, Route 4 Box 494-1, Buckhannon, was indicted on a felony count of nighttime burglary and a misdemeanor count of petit larceny stemming from charges that on April 16 he allegedly broke into and entered, or entered without breaking, a dwelling owned by Mae Hoover, John J. Gregory and Lucy Hoover, located at 24 Cleveland Ave., Buckhannon and stole a 1992 class ring, a silver ring with black top, one earring and various medications valued at about $300.

James David Heater, Route 9 Box 352, Buckhannon and Dewey Wade Tiffner, HC 71 Box 154, Ellamore, were indicted on felony charges of burglary and conspiracy and misdemeanor charges of petit larceny and conspiracy. According to the indictment, on Aug. 16, after having conspired to do so, Heater and Tiffner allegedly broke into and entered a house occupied by Virgil E. Perkins, located of Lee Glass Road, Buckhannon and stole a 50-inch Hitachi flat screen television, a Kobalt knife set, a pocket knife and a Leatherman tool.

Leonard Franklin Travis, Box 365, Mt. Clare, was indicted on charges of obtaining money, property and services by false pretenses, a felony. The indictment stems from charges that in August 2009, he allegedly obtained about $6,988.87 from Arnett W. Crawford and Connie Roth, by means of false pretense, token or representation.

Randy J. Bowman, Route 9 Box 571, Buckhannon, was indicted on two counts of first-degree sexual assault and two counts of sexual abuse by parent, guardian or custodian, all felonies. According to the indictment, in 2002 and 2003, Bowman allegedly engaged in sexual intercourse with an 11-year-old female against her will and without consent, while she was under his care, custody and control.

Earl Edward Carver Jr., address unknown, was indicted on four felony counts of distribution and displayed to minor obscene matter, stemming from charges that in February he display four photographs containing obscene matter to a 14- year-old person.

Larry Gail Courtney II, Box 273, Buckhannon, was indicted on four felony counts of failure to provide notice of change in sex offender registry information. According to the indictment, in February, Courtney allegedly failed to notify the Buckhannon detachment of the West Virginia State Police that he changed his residence from 41 Thurman Ave., Buckhannon to 102 Hedrick Drive, Flatwoods and transferred a 1995 Jeep Grand Cherokee registered in his name to another person. The indictment further states that in January, he allegedly failed to notify state police that he purchased a 1999 Jeep Grand Cherokee and in March, allegedly failed to notify state police that he obtained a new cellular telephone with a new telephone number.

Dana Jackson Davidson, of Weston, was indicted on charges of failure to provide notice of change in sex offender registry information, a felony, stemming from charges that in January he allegedly failed to notify the Buckhannon detachment of the West Virginia State Police within 10 business days of his possession of a 1989 Buick LaSabre.

Bryan David Shaw, address unknown, was indicted on charges of domestic battery, third or subsequent offense, a felony. According to the indictment, on June 12, Shaw allegedly threatened to strike his mother with a sledgehammer.

Jeral Keith Chidester Jr., Route 4 Box 648, Buckhannon, was indicted on three felony counts of delivery of a controlled substance, cocaine, stemming from events on Feb. 10, Feb. 21 and March 18.

Roy Horton, 620 Locust Ave., Clarksburg, was indicted on two felony counts of driving under the influence of alcohol, third or subsequent offense and driving while license revoked for DUI, third or subsequent offense, a felony, stemming from events on Feb. 14.

Edward Randolph Hosaflook, Route 1 Box 27-B, French Creek, was indicted on two felony counts of driving under the influence of alcohol, third or subsequent offense stemming from events on May 31.

Debbie Joann Smith, HC 71 Box 184, Ellamore, was indicted on four counts of delivery of a controlled substance and two counts of possession with intent to deliver, all felonies, stemming from events on Oct. 12, 2009, and March 18 and 27.

Brian Michael Wodzinski, Route 2 Box 394, Buckhannon, was indicted on three felony counts of delivery of a controlled substance, marijuana, stemming from events in September and October 2009.

Ervin William Hinkle, HC 32 Box 114, Cleveland, was indicted on charges of delivery of a controlled substance, hydrocodone, a felony, stemming from events on Nov. 20, 2009.

Steven Larry Harper, Route 10 Box 36, Buckhannon, was indicted for delivery of a controlled substance, marijuana, a felony; two felony counts of possession of a controlled substance with intent to deliver; and two misdemeanor counts of possession of a controlled substance, stemming from events in January 2007 and January 2010.

Jason Benton Barcus, Route 2 Box 318, Buckhannon, was indicted for delivery of a controlled substance, marijuana, a felony, stemming from events in February 2009.

James David Heater, Route 9 Box 352, Buckhannon, was indicted on charges of manufacturing a controlled substance, marijuana, a felony, stemming from events on May 29.

Robert Roscoe Phillips Jr., Box 246, French Creek, was indicted on charges of manufacturing a controlled substance, marijuana, stemming from events on April 10.

Steven Allen Black, 130 Hickory Flat Road, Buckhannon, was indicted on a misdemeanor count of discharge of a firearm within 500 feet of a dwelling house, stemming from events on May 31.

The Upshur grand jury will reconvene Monday to consider further indictments.
