Man facing domestic battery charges

An Elkins man remained incarcerated Monday after he allegedly tried to choke a family member's girlfriend.

Jeramiah White, 31, was arrested and charged with domestic battery, third offense, a felony, on Sunday.

According to the criminal complaint in the Randolph County Magistrate Clerk's Office, at approximately 4 p.m., Deputy Sheriff B.T. Sharp with the Randolph County Sheriff's Office was dispatched to a residence on the Country Club Road to respond to a domestic incident.

When Sharp arrived on scene, he could hear yelling from inside the residence and upon encountering White, instructed him to step out onto the front porch. Sharp also saw an adult female victim who had red discoloration on her neck and "appeared to be in distress," according to the complaint.

The report states that the victim is in a relationship with a member of White's family - and that White and the victim live in the same residence.

White was subsequently taken into custody and charged with domestic battery, third offense, after a search of the database in the magistrate clerk's office showed he had two prior convictions of domestic battery in Randolph County Magistrate Court.

The prior instances both occurred on May 18, 2012, according to the complaint.

Sharp noted that he was familiar with the residence based on prior domestic battery complaints.

"I had prior knowledge of the location of the residence due to previous law enforcement calls at that residence," Sharp wrote.

Magistrate George M. Riggleman set bond at $10,000 cash only, and White remained in the Tygart Valley Regional Jail as of presstime.

The penalty for domestic battery, third offense, is imprisonment in the state penitentiary for one to five years, a fine of up to $2,500 or both.
