Former inmate accepts pretrial diversion

A former inmate at Huttonsville Correctional Center accepted a pretrial diversion agreement Tuesday in Randolph County Circuit Court, meaning charges against him will be dismissed so long as he adheres to certain requirements.

In March, Randall Beatty, 26, now residing in Mineral Wells, pleaded not guilty to two felonies - one count of bribery in official and political matters and one count of conspiracy to commit bribery. Beatty had been accused of allegedly bribing a correctional officer to smuggle tobacco into the prison in April 2012.

After he declined to accept a plea agreement extended by the Randolph County Prosecuting Attorney's office in court Friday, Beatty accepted a 24-month pretrial diversion agreement Tuesday afternoon.

According to the terms of the agreement, charges against Beatty will be dismissed without prejudice; however, if he fails to adhere to a specified list of conditions at any time over the next two years, they may be brought back up again in court, Randolph County Prosecuting Attorney Michael Parker said Tuesday.

Beatty's case had been set to go to trial today and was scheduled for three days.

In February, Beatty was named in two counts of a 19-count indictment also involving Paul Edward Bibbee, 47, an inmate at Huttonsville Correctional Center, Alston W. Jackson, 49, of Buckhannon, and Ralph Richard Morgan, 37, an inmate at Huttonsville Correctional Center.

The indictment alleges that Beatty bribed Jackson - who, at the time, was employed as a Huttonsville correctional officer - to smuggle tobacco into the prison on April 12, 2012.

On Friday in Circuit Court, Jackson pleaded guilty to one felony count of bribery in official and political matters and one count of conspiracy to commit bribery.
