AB student charged with sexual assault

PHILIPPI - An Alderson-Broaddus University student was arrested Tuesday in relation to two alleged sexual assaults on the campus, police said.

Kadontae Y.J. Brooks, 19, of Florida, was charged with three felony counts of second degree sexual assault. He was being held in Tygart Valley Regional Jail on $15,000 bond as of presstime.

Brooks was a member of the Alderson Broaddus volleyball team in the 2012-13 season.

Philippi City Police received separate reports from two

alleged victims, according to a press release from Chief Jeff Walters.

"During the initial report... the investigation yielded a second victim who also alleged she was sexually assaulted by (Brooks), and the charges were brought forth together," Walters said in the release.

According to the criminal complaint, the first alleged victim reported an incident from Aug. 27. She told police that Brooks hosted an underage drinking party where the first alleged assault occurred, according to the complaint.

Police also spoke to a witness who reportedly said the alleged victim was heavily intoxicated at the party, to the point that she needed assistance getting upstairs. The witness said he and Brooks took her to Brooks' bed and then the witness left the party, according to the

complaint.

The alleged victim told police that she awoke the next morning in bed with Brooks and he told her they had sex in the night, the complaint states. She said he then had sex with her again while she was "still very intoxicated and unable to respond," according to the complaint.

When police questioned Brooks about the first incident, he admitted to having sex with the alleged victim several times, saying she "was crying and had trouble walking," according to the complaint.

The second alleged assault was reported Nov. 4. The second alleged victim told police that Brooks was intoxicated and fondled her, then the next day returned to her room and started taking his clothes off, the complaint states.

The alleged victim told police that she told Brooks to stop and asked him to leave, but he tried to force her to perform oral sex on him and then tried to remove her clothes, according to the criminal complaint.

Brooks told police he did have oral sex with the second alleged victim, but said he "believed it was

consensual."
