Man charged with driving offense

TENNERTON – Frank A. Harvey, 50, of Buckhannon is free on bond after being arrested over the weekend and charged with driving revoked for DUI, third offense, a felony.

According to a criminal complaint in the Upshur County Magistrate Clerk’s office, Harvey was driving a black Ford F-150 pickup on State Route 20 Sunday afternoon near Tennerton.

The complaint says Cpl. B.K. Wright, a state trooper, noticed that Harvey was operating a cellphone and not wearing his seatbelt, so he pulled him over.

The officer then learned that Harvey’s license had been revoked for DUI and that he had been charged with driving revoked for DUI on Aug. 18, 2009, the complaint says.

A criminal background check also revealed, according to the complaint, that Harvey has two previous driving revoked convictions with disposition dates of July 13, 2004, and July 7, 2009.

Bond was set at $15,000, and Harvey is free on bond.

The penalty for conviction of driving revoked for DUI, third offense, is imprisonment in a state penitentiary for one to three years and a fine of between $3,000 and $5,000.
