44 grand jury indictments returned

ELKINS — A Division of Corrections inmate accused of assaulting a correctional officer and fleeing while being treated at Davis Medical Center was named in one of 44 indictments handed down by a Randolph County grand jury Monday.

Mark Duwayne McAtee, 23, of Valley Bend, was indicted on one felony count of robbery in the first degree, one felony count of malicious assault upon a governmental representative, one felony count of escape by persons in custody of institutions or officers, one felony count of possession of a stolen vehicle and one felony count of grand larceny.

McAtee was being treated at the hospital for undisclosed reasons when he assaulted an officer from the HCC, police said.

Between 3 and 4 a.m. on Dec. 7, former Patrolman First Class K.A. Shiflett and Patrolman A.M. Wyshyvanuk, both of the Elkins Police Department, went to DMC and met with the alleged victim, who was bleeding from his head and whose hands were handcuffed behind his back, according to court documents.

The alleged victim told officers he had got up to use the restroom when McAtee attacked him, handcuffed him and jumped out a second-story building. The alleged victim received 11 staples in the back of his head as a result of the injuries he sustained in the assault, the criminal complaint states.

McAtee fled in an allegedly stolen 2005 Ford Taurus with a license plate number of 4ZC-472. Hospital security footage showed he exited DMC going south toward U.S. 33, police said.

The vehicle was discovered, still running, at about 5 a.m. near Revelle’s River Resort off U.S. 33 near Bowden. Law enforcement agencies, including multiple K-9 units, from around the area assisted with the search, authorities said.

McAtee was captured in the campground area at about 10:30 a.m. the same day, by the West Virginia Division of Corrections CERT team and members of the West Virginia State Police, police said.

Earlier that day, downtown Elkins businesses were on lockdown as a precaution, as threats had been made while McAtee was at the hospital. Members of the EPD stood watch at DMC until about 7 a.m., as a precaution, authorities said.

McAtee was believed to be armed and dangerous, with what was described in police scanner traffic as a homemade “shiv.”

He had been sentenced to one to 15 years for burglary by breaking and entering in Harrison County on July 8, 2013. His intake date at HCC was Oct. 10, 2013, and his projected release date is Aug. 24, 2020, according to the West Virginia Division of Corrections website.

Other indictments handed down include:

• Willis James Wilson, 30, of Elkins, was indicted on one felony count of unlawful assault upon a governmental representative and one felony count of offense committed by inmate.

• Gary Roger Lowery Sr., 67, of Mabie, was indicted on two felony counts of sexual abuse in the first degree and two felony counts of sexual abuse by a parent, guardian, custodian or person in a position of trust to a child.

• Daniel Ryan Spencer, 30, of Elkins, was indicted on four felony counts of soliciting a minor via computer, one felony count of display to minor of obscene matter and one felony count of use of obscene matter with intent to seduce a minor.

• Johnny Hayward McCourt, 58, of Webster Springs, was indicted on one felony count of driving while impaired causing death, one misdemeanor count of driving while impaired, second offense, and one misdemeanor count of reckless driving.

• Josue Mateo Bonilla, 34, of Beverly, was indicted on one felony count of robbery in the first degree, one felony count of malicious assault and one felony count of conspiracy.

• Tisha Faye Hinchman, 45, of Elkins, was indicted on one felony count of robbery in the first degree, one felony count of conspiracy and one felony count of failure to appear.

• Caroline Elizabeth Cain, 42, of Elkins, was indicted on one felony count of robbery in the first degree and one felony count of conspiracy.

• James Anthony Banks, 22, of Belington, was indicted on one felony count of fleeing in a vehicle with reckless disregard and five felony counts of possession with intent to deliver a controlled substance.

• Kevin James Parrack, 32, of Beverly, was indicted on one felony count of escape by persons in custody or institutions or officers and one misdemeanor count of destruction of property.

In a separate and unrelated indictment, Parrack was indicted on one felony count of breaking and entering, one felony count of grand larceny, and one felony count of conspiracy.

• Isaac Carl Nelson, 26, of Elkins, was indicted on four felony counts of possession with intent to deliver a controlled substance and one misdemeanor count of possession of counterfeit with intent to utter.

• David Wayne Crites, 49, of Monterville, was indicted on one felony count of possession with intent to deliver a controlled substance and one misdemeanor count of knowingly keeping or maintaining a dwelling, building, or other structure or place for the purpose of using or selling controlled substances.

• Joshua Derek Raines, 33, of Mill Creek, was indicted on one felony count of possession with intent to deliver a controlled substance, one felony count of conspiracy and one misdemeanor count of shoplifting, second offense.

• Sharon Lynn Austin, 45, of Elkins, was indicted on two felony counts of possession with intent to deliver a controlled substance.

• Nicholas Adam Owens, 22, of Elkins, was indicted on one felony count of possession with intent to deliver a controlled substance and one misdemeanor count of defective equipment.

• Darin Joseph Brooks, 29, of Elkins, was indicted on one felony count of possession with intent to deliver a controlled substance.

• Chelsie Lynn Webb, 26, of Elkins, was indicted on two felony counts of breaking and entering, two felony counts of grand larceny, and two felony counts of conspiracy.

• Brandon Tyler Jackson, 20, of Elkins, was indicted on one felony count of breaking and entering, one felony count of grand larceny, and one felony count of conspiracy.

• Dale Michael Jackson, 20, of Elkins, was indicted on one felony count of breaking and entering, one felony count of grand larceny, and one felony count of conspiracy.

• Holly Renae Satterfield, 25, of Elkins, was indicted on one felony count of breaking and entering, one felony count of grand larceny, and one felony count of conspiracy.

In a separate and unrelated indictment, Satterfield was indicted on two felony counts of possession with intent to deliver a controlled substance, one felony count of conspiracy and one felony count of shoplifting, third offense.

• James Dean Grover Jr., 24, of Elkins, was indicted on one felony count of breaking and entering, one felony count of grand larceny, and one felony count of conspiracy.

• Bradley Neil Parrack, 31, of Beverly, was indicted on one felony count of breaking and entering, one felony count of grand larceny, and one felony count of conspiracy.

• Allen Wayne Kirkpatrick, 40, of Norton, was indicted on one felony count of breaking and entering, two felony counts of grand larceny, one felony count of conspiracy, and one misdemeanor count of destruction of property.

• Michael David Nine, 32, of Elkins, was indicted on one felony count of breaking and entering, two felony counts of grand larceny, one felony count of conspiracy, and one misdemeanor count of destruction of property.

• Vincent Matthew Kelly-Zito, 31, of Elkins, was indicted on one felony count of grand larceny, two felony counts of possession of a stolen vehicle, two felony counts of forgery, two felony counts of uttering and one felony count of failure to appear.

• Delmus Owen Lambert, 36, of Elkins, was indicted on one felony count of breaking and entering, and one felony count of grand larceny.

• Brandy Lee Caprio, 43, of Beverly, was indicted on one felony count of grand larceny and one felony count of conspiracy.

• Jerry Lee Bennett Jr., 28, of Belington, was indicted on one felony count of grand larceny and one felony count of conspiracy.

• Markie Leeann Jeffries, 30, of Montrose, was indicted on three felony counts of forgery, six felony counts of uttering and one felony count of conspiracy.

• Joshua Ryan Smith, 27, of Montrose, was indicted on two felony counts of forgery, two felony counts of uttering and one felony count of conspiracy.

• David Oscar Lambert, 37, of Elkins, was indicted on one felony count of receiving stolen goods and one felony count of conspiracy.

• Elizabeth Ann Lambert, 29, of Elkins, was indicted on one felony count of receiving stolen goods and one felony count of conspiracy.

• Alinor Roxanne Phillips, 29, of Mill Creek, was indicted on one felony count of forgery, one felony count of uttering and one felony count of attempted possession of a controlled substance by fraud.

• Tyler Scott Gillespie, 25, of Elkins, was indicted on one felony count of uttering, one felony count of conspiracy and one felony count of failure to appear.

• Christian Leann Stinson, 31, of Montrose, was indicted on one felony count of uttering, one felony count of conspiracy and one felony count of failure to appear.

• Ashley Marie Crowe, 26, of Elkins, was indicted on one felony count of grand larceny and one felony count of conspiracy.

• Charles Blaine Simmons, 45, of Elkins, was indicted on two felony counts of failure to register as a sexual offender of provide notice of registration changes.

• Tori Zenoa Brooke Knox, 21, of Mill Creek, was indicted on one felony count of conspiracy and two felony counts of shoplifting, third offense.

• Tiffany Nicole Henline, 34, of Elkins, was indicted on two felony counts of shoplifting, third offense.

• Sarah Beth Barrickman, 28, of Mill Creek, was indicted on one felony count of failure to appear.

• Kristin Michelle Gillette, 28, of Elkins, was indicted on one felony count of shoplifting, third offense.

• Jeremy Adam McCauley, 43, of Elkins, was indicted on one felony count of driving while license revoked for DUI, third offense.

The grand jury will reconvene at 9 a.m. today for additional presentations by the state.

The cases were presented by Prosecuting Attorney Michael W. Parker. Circuit Judge David Wilmoth presided.

Bond return hearings will be at 1:30 p.m. on July 5 at the Randolph County Circuit Courtroom.
