Elkins man facing felony charge

ELKINS — An Elkins man is facing a property related felony charges.

Dustin S. Isner, 29, is charged with receiving or transferring stolen goods. Bond was set for $10,000 by Randolph County Magistrate Rob Elbon.

According to the criminal complaint filed by Deputy S.D. Kyle of the Randolph County Sheriff’s Office, Kyle was informed of a possibly stolen side by side in the Mill Creek area on June 19, then responded to Dry Run Road where he observed the vehicle, valued at approximately $17,000.

The report additionally states that Kyle notified 911 with the vehicle’s VIN number, learning it was stolen from Upshur County. Kyle then spoke to and obtained a written statement from the owner of the side by side who told him that he had traded Isner his 2006 Ford F-150 for the vehicle on April 24.

The report states that the man was unable to provide a title for the vehicle but did provide a “bill of sale” that was signed by Isner. Kyle additionally stated that the man told him the trade was conducted at a residence in the Glenmore area and that he provided text messages to corroborate his statement.

The report additionally states that Kyle obtained a written statement from Isner stating the details of the trade, additionally stating that he had owned the side by side for approximately two years before trading and that the vehicle was less than one year old when he purchased it for $5,000.

“He stated that he purchased it from a gentleman that has a towing service in Philippi but did not know his name or address. He stated that he did not receive a title, however did receive a bill of sale from the previous owner,” Kyle wrote. Isner reportedly stated that he could not locate the bill of sale because it was from two years ago.
