Elkins man facing firearm charge

ELKINS — An Elkins man is facing a felony charge after a firearm was allegedly found on his person.

Robert Jimmy Wolford, 31, is charged for being a prohibited person in possession of a firearm. His bond was set for $15,000 cash only by Randolph County Magistrate Judge Ben Shepler.

According to the criminal complaint filed by Trooper E.B. Malcomb of the West Virginia State Police, on October 9 at approximately 10 p.m., the officer was conducting a patrol of Riverbend Park when he located a motorcycle parked outside of the restroom area by the baseball field. The report states that when Malcomb ran the registration through WVSP Communications, it returned as a stolen plate number.

The report states that Malcomb noticed a male subject exiting the restroom area who was identified as Wolford.

According to Malcomb, he asked Wolford what he was doing in the park area, to which Wolford replied that he was riding his motorcycle stopped to use the restroom; Malcomb also asked if Wolford had any weapons on his person, to which Wolford replied that he did not.

The report states that Malcomb– alongside Senior Patrolman C.G. Boatwright of the Elkins City Police– patted down Wolford, at which time they located a Ruger pistol in Wolford’s boot and a crystal-like substance consistent with methamphetamine.

“A check through WVSP Elkins Communications indicated Mr. Wolford is prohibited from being in possession of a firearm. A check of Mr. Wolford’s criminal history revealed that he had been convicted of domestic battery 3 offense with an arrest date of August 13, 2014,” said Malcomb.

The report states that at approximately 10:45 p.m., Malcomb placed Wolford in custody for possession of a firearm by a prohibited person and that Wolford was transported to the WVSP Elkins Detachment and processed via live scan.

At approximately 12:30 a.m., Malcomb transported Wolford to the Tygart Valley Regional Jail, where he was taken into the custody of the West Virginia Division of Corrections and Rehabilitation, states the report.
