Upshur grand jury indicts 17

BUCKHANNON — An Upshur County grand jury indicted 17 people on Monday, on charges ranging from grand larceny to sexual abuse.

Barbara Sue Mitchell, 59, of Buckhannon, was charged with sexual abuse in the first degree and sexual abuse of a child by a parent, guardian or person in a position of trust, both felonies.

On Dec. 29, 2020, the West Virginia State Police took a complaint from a woman who called 911 to report alleged sexual abuse against her son. The alleged victim, a 4-year-old, told his mother that Mitchell had allegedly touched him inappropriately while giving him a shower, the criminal complaint states.

On Jan. 22, the alleged victim had a forensic interview at Mountain CAP’s Child Advocacy Center, and stated that Mitchell touched his private area, according to the complaint.

Mitchell allegedly confessed to the act and said she told the 4-year-old, “No, we aren’t supposed to do that. That’s not nice at all.”

Mitchell then said she told the alleged victim to not talk about the incident to anyone. Mitchell told Robinette that this was the only incident to occur but that she had watched the boy frequently, the complaint states.

Also indicted Monday were:

Eric Wayne Richards, 38, of Walkersville, charged with three counts of driving while license revoked for DUI third of subsequent offense, a felony; and two counts of having no insurance, a misdemeanor.

Dallas Sterling Lantz, 34, of Buckhannon, charged with driving while license revoked for DUI third of subsequent offense, a felony; and having no insurance, a misdemeanor.

Jennifer Lyn Moreland, 37, of Buckhannon, charged with possession of a controlled substance with the intention to deliver, methamphetamine, a felony.

Charyn Elizabeth Fortune, 31, of Chapmanville, charged with grand larceny, a felony.

Joseph Brian Kelley, 28, of Buckhannon, charged with being a prohibited person in possession of a concealed firearm, being a prohibited person in possession of a firearm, false evidence of registration, and possession of a controlled substance with the intent to deliver, methamphetamine, all felonies.

Blaine Allen Ash, 37, of Salem, charged with driving while license revoked for DUI third of subsequent offense, and three counts of possession of a controlled substance with the intent to deliver, methamphetamine, buprenorphine and alprazolam, all felonies.

Christopher Michael Lipps, 31, of Jane Lew, charged with fleeing in a vehicle with reckless indifference to the safety of others, a felony; and fleeing on foot, a misdemeanor.

Christopher Wayne Tenny, 33, of Pickens, charged with escape from custody, a felony.

Joshua Lee Swiger, 29, of Bridgeport, charged with forgery and uttering, both felonies.

Breauna Kay Heater, 27, of Fairmont, charged with grand larceny, a felony.

Robert Lee Blish, 42, of French Creek, charged with two counts of sexual abuse in the first degree, a felony.

Justin Skyler Hoover, 26, of Lumberport, charged with grand larceny, a felony.

Alan Lee Stanley, 41, of Buckhannon, charged with escape from custody, a felony.

Zachary Anton McCartney, 28, of Crawford, charged with four counts of possession of a controlled substance with the intent to deliver, heroin, fentanyl, methamphetamine and clonazepam, all felonies.

Daniel Travis Dunlavy, 30, of Buckhannon, charged with driving while license revoked for DUI third of subsequent offense, a felony; and leaving the scene of a motor vehicle crash with damage to a vehicle, a misdemeanor.

Tyler Lynn Wolford, 29, of Buckhannon, was charged with two counts of failure to provide notice of a change in sex offender registration information, life registrant, a felony.
