Fight in Elkins parking lot leads to a felony charge
ELKINS — A fight among several men in an Elkins parking lot Wednesday night led to one man being arrested and another man being hospitalized in critical condition.
Daniel Kenton Leach, 39, is charged with malicious wounding, a felony. He is being held in the Tygart Valley Regional Jail on a $20,000 cash-only bond, set by Magistrate Mike Dyer.
According to the criminal complaint, prepared by Patrolman C. Mayle of the Elkins Police Department, he was patrolling Railroad Avenue in Elkins at about 10 p.m. Wednesday when he “observed a physical altercation between several male subjects” in the Holiday Inn Hotel parking lot.
Mayle exited his vehicle and presented his firearm and “ordered all subjects to the ground,” the complaint states.
The officer then observed “a male subject to be unresponsive, laying on his side,” according to the complaint.
The other men told the officer that Leach had “came up to them making threats,” then “left and returned,” which could be seen on the Holiday Inn’s video surveillance, according to the complaint. Leach allegedly continued to threaten the men, and a physical altercation took place.
The alleged victim was transported to Davis Medical Center for treatment of injuries “which were sustained to his head, and is still currently in critical condition per medical staff where he is being treated,” Mayle wrote.
Leach was also transported to DMC for treatment of injuries, the complaint states.
If convicted of the charge, Leach could be sentenced to up to 10 years in prison.
