ELKINS -- An Elkins man has been charged with DUI third offense, a felony.
Milton Theodore Broseker, 51, was arrested Jan. 12. Bond was set at $10,000 cash or surety by Randolph County Magistrate George M. Riggleman.
According to the criminal complaint, Deputy A.B. Beverly, of the Randolph County Sheriff's Office, observed a gold Ford Ranger bearing temporary registration traveling southbound on Harpertown Road in Elkins.
"The vehicle was being operated without headlights and had apparent damage to the front of the vehicle," the complaint states.
Beverly wrote in the police report that when he spoke to Broseker, "I immediately detected the strong odor of alcohol on the defendant's breath." Beverly said Broseker admitted to drinking before driving his vehicle, but "refused to submit to any breath tests or standardized field sobriety tests."
The police report states that "the defendant had a bottle containing alcohol in the passenger side of his vehicle."
Broseker has been convicted of DUI twice, in May 2012 and in September 2012, the complaint states.
