ELKINS -- An Elkins man is facing felony charges after allegedly impregnating a 13-year-old girl.
Martin Shane Roy, 42, is charged with sexual assault in the second degree and sexual abuse by a parent or guardian. His bond was set for $100,000 cash only.
According to the criminal complaint filed by Sgt. K.A. Corley of the West Virginia State Police, who was present during the forensic interview of the alleged victim, she stated that she was placed in Roy's care while her mother was incarcerated. The report states that the alleged victim was given a pill by Roy that made her pass out and that when she woke up "she discovered that her pants were down and her feet were tied together."
The report states that when interviewed, Roy's son advised CPS that his father had told him that "he had a vision that he had sexual intercourse with (the alleged) victim," and that the alleged victim went into Roy's room, "climbed on top of him" and "had sexual intercourse."
Additionally, the report states that, when given a ride to a convenience store by his ex-wife, Roy admitted to having visions of sexual intercourse with the alleged victim.
According to Corley, he obtained a digitally recorded statement from Roy, who advised that he received a phone call from the Elkins Police Department concerning the alleged victim, wherein he agreed to house her during her mother's incarceration in December 2018.
According to the report, Roy additionally advised that the alleged victim "wasn't using her female products." The report states that when Roy asked the her why, she stated that she might have been pregnant; Roy obtained a pregnancy test, confirming that the alleged victim was pregnant.
Corley stated that he inquired about the visions that Roy had told his son about, to which Roy replied that "(the alleged victim) told him that she came into his room," "climbed on top of him" and "had sexual intercourse with him."
The report also states that Roy advised that he didn't believe that he had intercourse with the alleged victim.
According to Corley, he obtained Roy's saliva, fetal tissue and the alleged victim's DNA for DNA comparison. The results were sent to the Marshall University Forensic Science Center for analysis, and the results confirming that Roy was the father, the report states.
