ELKINS — A Randolph County man allegedly found in possession of an assortment of drugs as well as digital scales waived his preliminary hearing Monday in Randolph County Magistrate Court.

Cody Wayne Rexrode, 31, of Mill Creek, is charged with one felony count of possession of a controlled substance with intent to deliver. He remains incarcerated at Tygart Valley Regional Jail on a $50,000 cash or surety bond, set by Randolph County Magistrate Rob Elbon.

His waiver means his case will be bound over to the Randolph County Circuit Court for presentation to a grand jury.

Randolph County Assistant Prosecuting Attorney Leckta Poling represented the state while Rexrode appeared with David Fuellhart as defense counsel. Elbon presided.

According to a criminal complaint filed in Randolph County Magistrate Court, at approximately 6:15 p.m. on Aug. 11, West Virginia State Police Senior Trooper D.T. Stallings received a complaint regarding a suspicious male behind an apartment building in Huttonsville.

While en route, Stallings also received information that the male was allegedly participating in “drug related activities.” Upon arrival, Stallings located a male sitting behind the aforementioned apartment building who matched the description given. He was identified as Rexrode, police said.

Stallings observed Rexrode to have a closed folding knife in his hand. After securing the weapon, Stallings conducted a pat-down search of Rexrode, according to the complaint.

During the search, Stallings located a black, cloth zipper case within Rexrode’s pants. Inside were two plastic bags, each containing a substance consistent with methamphetamine; one plastic bag containing a white circular tablet marked “411,” consistent with a buprenorphine (sublingual) 8 mg tablet; and numerous small empty plastic bags, the complaint states.

Stallings also obtained consent to search Rexrode’s backpack. Inside were two sets of digital scales and a square plastic container, containing 12 white, oval tablets marked “58 TV,” consistent with Tramadol Hyrdrochloride 50 mg tablets, court documents state.

Rexrode was placed into custody and taken to the Elkins detachment of the WVSP. During an interview he said he had conducted the sale of methamphetamine, for monetary gain, in Huttonsville, according to the complaint.

If convicted, Rexrode could be sentenced to not less than one year nor more than five years in the state penitentiary, fined not more than $15,000, or both.
