Upshur Man arrested for alleged UTV theft

BUCKHANNON — A Buckhannon man remains in the Tygart Valley Regional Jail after allegedly stealing a 2015 UTV.

On May 24, Brandon Levi Wagoner, 21, allegedly took a camo 2015 Benneche 700 UTV valued around $12,000 from an open storage building on the Spruce Fork Road, according to the criminal complaint in the Upshur County Magistrate Clerk’s office.

The UTV had not been recovered at the time of Wagoner’s arrest, according to Chief Deputy Mike Kelley with the Upshur County Sheriff’s Department.

A video confession from Wagoner was taken Friday evening May 24. The owner of the UTV was also given information supporting Wagoner’s role in taking the ATV from an independent witness, according to the criminal complaint.

Wagoner was arrested Wednesday for grand larceny, a felony.

Magistrate Kay Hurst set bond at $50,000 cash or surety.

If convicted, Wagoner faces confinement in the penitentiary for one to 10 years or in the discretion of the court be confined in jail for up to one year and fined not more than $2,500.
