Randolph grand jury indicts 32

ELKINS -- A total of 32 individuals were indicted by a Randolph County grand jury meeting Monday.

Monday's indictments include charges such as sexual assault, malicious assault, and possession with intent to deliver a controlled substance.

The indictments include:

• Kyle Brent Hoyman, 29, an inmate at Tygart Valley Regional Jail, was indicted on one count of sexual assault in the second degree, a felony, and one count of sexual assault in the third degree, a felony.

According to the criminal complaint, the alleged victim, now 19 years old, advised the officer that she was sexually assaulted by the 24-year-old Hoyman at age 14, resulting in a pregnancy.

The report states that documents were obtained during Corley's investigation that indicated the results of DNA testing -- including a DNA test report, the birth certificate of the alleged victim's daughter and notice of filing of paternity test -- resulting that Hoyman was the father of the child.

• Casey Warren Lang, 28, an inmate at Tygart Valley Regional, was indicted on one count of receiving stolen goods, a felony; and, in a separate indictment, was indicted on three counts of possession with intent to deliver a controlled substance, a felony; two counts of conspiracy, a felony; and 14 counts of possession by a prohibited person of a firearm, a misdemeanor.

According to the criminal complaint, on June 29 a deputy spoke to a cooperating witness who said he had observed Lang "open a large combination safe and place an amount of 'meth' in the safe which was too large to hold in one hand." The witness said he also saw several guns as well as "weed" in the safe.

On June 30, a search warrant was executed on a storage building, which was opened using a key in Lang's possession. On July 3, a second search warrant was executed by unlocking and seizing the contents within the safe, the report states.

Inside the safe, officers allegedly found approximately 155 grams of "a crystal-like substance which appears to be and is consistent with methamphetamine," a "significant amount" of what appeared to be marijuana, and ammunition and several firearms, according to the report. Also allegedly seized from the safe were digital scales, small plastic bags, $2,201 in currency and "drug paraphernalia."

Lang's name was on at least one prescription bottle within the safe, and a check for $160 was written to Lang and found inside the safe, the report states. A search of Lang's criminal history indicated he is prohibited from possessing firearms, police said.

• Corey Michael Smith, 24, an inmate at Tygart Valley Regional Jail, was indicted on one count of malicious assault, a felony.

The criminal report states that on June 14 the alleged victim had given Smith cigarettes and a drink when Smith stood up and struck the alleged victim in the head with a hammer.

A witness, in a signed, written statement, said the alleged victim was going to let Smith use his phone when he attacked him, the report states.

• Cornell Lee Smith, 53, an inmate at Tygart Valley Regional Jail, was indicted on one count of fleeing in a vehicle with reckless Indifference, a felony; one count of driving while license revoked for DUI, third offense, a felony; one count of possession with intent to deliver a controlled substance, a felony; one count of reckless driving, a misdemeanor; and one count of fleeing from an officer by any means other than the use of a vehicle, a misdemeanor.

In a separate indictment, Smith was indicted on one count of driving while license revoked for DUI, third offense, a felony; and one count of failure to appear, a felony.

According to a criminal complaint, on Sept. 20, Smith led police on a pursuit on the Adolph Road while driving an ATV, and then jumped off the vehicle and fled on foot.

• Robert Wayne Blagg, 35, an inmate at Tygart Valley Regional Jail, was indicted on two counts of failure to register as a sexual offender or provide notice of registration changes, second or subsequent offense, a felony.

• Ricky Allen Fortney, 36, an inmate at Tygart Valley Regional Jail, was indicted on one count of failure to register as a sexual offender or provide notice of registration changes, second or subsequent offense, a felony.

• Virginia Ellen Fortney, 44, of Elkins, was indicted on two counts of possession with intent to deliver a controlled substance, a felony; and one count of conspiracy, a felony.

• Keith Allen Watson, 32, of Elkins, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

• Caleb Lee Goodwin, 27, an inmate at Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

• Dalton Dale Irvine, 31, of Marlinton, was indicted on one count of possession with intent to deliver a controlled substance, a felony; and one count of conspiracy, a felony.

• Brandy Lynn Kerr, 38, of Elkins, was indicted on one count of burglary, a felony, and one count of grand larceny, a felony.

• Raymond Lee Kirkpatrick, 39, an inmate at Tygart Valley Regional Jail, was indicted on one count of possession of a stolen vehicle, a felony, one count of fleeing from an officer by any means other than the use of a vehicle, a misdemeanor, and one count of failure to appear, a felony.

• Destiny Marie Lane, 19, of Elkins, was indicted on one count of obtaining property in return for a worthless check, a felony.

• Brian David Lang, 27, of Valley Head, was indicted on four counts of fraudulent use of an access device, a felony.

• Kara Brooke Falkner, 25, of Valley Head, was indicted on three counts of possession with intent to deliver a controlled substance, a felony, and one counts of conspiracy, a felony.

• John Martin Lawrence, 26, of Elkins, was indicted on one count of sexual assault in the first degree, a felony, one count of sexual abuse by a parent, guardian, or custodian, a felony, and one count of incest, a felony.

• Kimberly Dawn Maxwell, 35, of Elkins, was indicted on one count of shoplifting, third offense, a felony.

• Kallee Nora McLaughlin, 20, of Elkins, was indicted on one count of fleeing in a vehicle with reckless indifference, a felony, and one count of operating a motor vehicle exceeding speed limitations, a misdemeanor.

• Veronica D. Myles, 59, of Fairmont, was indicted on seven counts of Medicaid fraud, a felony, and one count of fraudulent schemes, a felony.

• Steven James Phares, 31, an inmate at Tygart Valley Regional Jail, was indicted on one count of fleeing in a vehicle with reckless indifference, a felony, one count of fleeing from an officer by any means other than the use of a vehicle, a misdemeanor, one count of reckless driving, a misdemeanor, one count of no insurance, a misdemeanor, three counts of failure to stop at a posted stop sign, a misdemeanor, and one count of operating a motor vehicle exceeding speed limitations, a misdemeanor.

• Joshua Derek Raines, 36, of Elkins, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of possession by a prohibited person of a firearm, a misdemeanor.

• Aimee Beth Redden, 40, of Elkins, was indicted on two counts of failure to register as a person convicted of child abuse or neglect or provide notice of registration changes, second or subsequent offense, a felony.

• William Joseph Robinson, 34, of Mingo, was indicted on one count of breaking and entering, a felony, and one count of petit larceny, a misdemeanor.

• Michael David Rollins, 30, of Elkins, was indicted on four counts of fraudulent use of an access device, a felony.

• Brett Adam Swecker, 38, an inmate at Tygart Valley Regional Jail, was indicted on two counts of possession by a prohibited person of a firearm, a felony.

• Lukas Daniel Thompson, 21, of Parsons, was indicted on ten counts of fraudulent use of an access device, a felony.

• Scottie Allen Vanover, 38, an inmate at Tygart Valley Regional Jail, was indicted on one count of shoplifting, third offense, a felony, and two counts of possession of a controlled substance, a misdemeanor.

• Harold Clifford Warren, 47, of Elkins, was indicted on one count of bribery, a felony, one count of obstructing an officer, a misdemeanor, and one count of possession by a prohibited person of a firearm, a misdemeanor.

• Katherine Ann Waybright, 48, of Montrose, was indicted on one count of possession with intent to deliver a controlled substance, a Felony, and one count of conspiracy, a felony.

• Hildie Mae Williams, 29, an inmate at North Central Regional Jail, was indicted on one count of possession of a stolen vehicle, a felony.

• Rocky Michael Wyatt, 29, an inmate at Tygart Valley Regional Jail, was indicted on two counts of retaliation against a public official or employee, a felony.

• The final case was presented by the Barbour County Prosecuting Attorney's Office, which is serving as special prosecutor in the case: Sierra Staten, 33, of Elkins, was indicted on one count of embezzlement, a felony, and 28 counts of falsifying accounts, a felony.

Bond return for the indictments returned by the October 2019 term of the Randolph County Grand Jury will be at 9 a.m. Tuesday, Nov. 5, at which time bond will be set and trial dates will be determined.

The fact that a defendant has been charged with a crime is merely an accusation and all defendants are presumed innocent until and unless proven guilty.
