Upshur grand jury indicts 23

BUCKHANNON — An Upshur County grand jury returned indictments against 23 individuals Monday, including a woman accused of embezzling from the Upshur County Special Olympics.

Charliena Jane Helmick Gilmore, 44, was indicted on one count of embezzlement, a felony; one count of falsifying accounts, a felony; and one count of conspiracy, a felony.

The alleged embezzlement took place between December 2015 and February 2019, and totaled $16,662.79, according to the criminal complaint from the Upshur County Sheriff’s Department.

The embezzled money was converted to Gilmore’s own use, the complaint alleges. Gilmore resigned from her position as director of the Upshur County Special Olympics in March 2019.

Also named in the indictments was Jamie Pugh, 42, the former chief of the Ellamore Volunteer Fire Department, who was indicted on count of first-degree arson, a felony.

According to the criminal complain, on March 30, Pugh allegedly set fire to a cabin located on Little Sand Run Road that belonged to Ralph Joseph Parsons.

Other indictments include:

Ryan Neil Coberly, 28, of Coalton, was indicted on one count of escape from custody, and one county of prohibited person in possession of a concealed firearm, both felonies; and one count of prohibited person in possession of a firearm, and one count of possession of a controlled substance, marijuana, both misdemeanors.

Jonathan William Dean, 31, of Buckhannon was indicted on one count of burglary, a felony, and one count of fraudulent use of an access device, a felony.

Dale Wayne DeBarr, 45, of Buckhannon, was indicted on one count of failure to provide notice of change in sex offender registration, life registrant, a felony.

Allison Christine Fultz, 31, of Buckhannon, was indicted on one count of burglary, a felony; one count of attempted strangulation, a felony; one count of battery, a misdemeanor; and two counts of destruction of property, a misdemeanor.

Michael Albert Gagnon, 66, of Buckhannon, was indicted on one count of failure to provide notice of a change in sex offender registration information, life registrant.

Daniel Scott Grogg, 25, of Buckhannon, was indicted on one count of first-degree arson, a felony.

Ervin William Hinkle, 35, of Kanawha Head, was indicted on one count of fleeing in a vehicle with reckless indifference to the safety of others, a felony.

Amber Ann Keener, 30, of Buckhannon, was indicted on one count of driving while license revoked for driving under the influence, third or subsequent offense, a felony.

Terry Lynn Ketterman, 60, of Buckhannon, was indicted on two counts of failure to provide notice of a change in sex offender registration information, life registrant.

Cassandra Dawn Kelley, 31, of Buckhannon, was indicted on one count of shoplifting, third or subsequent offense, a felony.

Skywaterblue Keys, 43, of Buckhannon, was indicted on two counts of felony shoplifting, third or subsequent offense.

April Elaine Linger, 28, of Buckhannon, was indicted on one count of burglary, a felony, and one count of petit larceny, a misdemeanor.

Boyd Lee Marteney, 66, of Buckhannon, was indicted on one count of failure to register as a sex offender, a felony, and one count of sexual abuse in the first degree.

Zachary Wilson Patterson, 24, of Buckhannon, was indicted on three counts of fraudulent use of an access device.

Justin Phipps, 33, of Buckhannon, was indicted on one count of strangulation, a felony, and one count of domestic battery, a misdemeanor.

Leslie Ann Ramsey, 35, of Gassaway, was indicted on one count of failure to appear, a felony.

Garrett Wade Riley, 26, of Buckhannon, was indicted on one count of possession of a controlled substance with intent to deliver, methamphetamine, a felony.

Jeffrey Andrew Saltis, 26, of Buckhannon, was indicted on two counts of breaking and entering, and one count of grand larceny, both felonies; and one count of petit larceny, and two counts of conspiracy, both felonies.

Kendall Slade Tenney, 25, of Buckhannon, was indicted on two counts of burglary, one count of forgery, and one count of uttering, all felonies; and two counts of petit larceny, a misdemeanor.

Thomas Lee Underwood, 36, of Buckhannon, was indicted on one count of burglary, a felony; and one count of domestic assault, one count of brandishing a deadly weapon, and one count of violation of a protective order, all misdemeanors.

Tivis Lee Wallen, 47, of Buckhannon, was indicted on two counts of failure to provide notice of a change in sex offender registration information, life registrant, a felony.

An indictment is merely an accusation. A defendant is presumed innocent unless and until proven guilty.
