Grand jury hands down 37 indictments

ELKINS -- Charges against an Elkins man accused of threatening to kill the town's mayor were among the 37 indictments handed down by a Randolph County grand jury on Monday.

Robert Lee Bowers, 59, was indicted on one felony count of threats of terroristic acts, one felony count of retaliation against a public official or employee, two misdemeanor counts of assault and one misdemeanor count of battery.

According to court documents, Randolph County Sheriff's deputies spoke with Elkins Mayor Van Broughton after the alleged incident in April 2019, at which time Broughton advised deputies that he had been driving and stopped at an intersection in downtown Elkins, at which time Bowers pulled up beside him and began threatening him.

Broughton allegedly told deputies that Bowers told him he would "kill him right now" and that he would be "saving the tax payers' money by killing" him. According to documents, Bowers also allegedly told Broughton that his time was "coming to an end."

Also indicted was a man accused of injuring his five-week-old child.

David Christian Humphrey, 20, was indicted on one felony count of child abuse resulting in bodily injury and one misdemeanor count of domestic battery.

According to court documents, officers responded to a call from Davis Medical Center in reference to a five-week-old child who was being physically abused, and law enforcement observed bruising on the child's hands, wrists and shoulders upon responding to the scene.

While speaking to the child's mother, officers were informed that she and Humphrey had been arguing prior to the alleged abuse. "She stated that she stepped outside to smoke a cigarette and to make a phone call, and she heard the baby crying," court documents read, adding that the mother said she then went back inside to ask Humphrey what happened and that the baby "jerked back" when he moved her from his shoulder. The report goes on to state that the mother's aunt then came to pick her up and noticed bruises on the baby's fingers and wrists while she was changing its diaper.

Other indictments handed down on Monday include:

Katrina Patrice Barker, 28, of Clarksburg, was indicted on one felony count of transportation of controlled substances onto the grounds of a correctional facility, one felony count of attempted delivery of contraband to an inmate, and one felony count of conspiracy.

Austin Jeremiah Lodge, 27, an inmate at Huttonsville Correctional Center and jail, was indicted on one felony count of transportation of controlled substances onto the grounds of a correctional facility, one felony count of attempted possession of a controlled substance by an inmate, one felony count of offense committed by an inmate and one felony count of conspiracy.

Gerald Paul Bennett, 38, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of burglary, one felony count of conspiracy and one misdemeanor count of petit larceny.

Gary David Smith, 41, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of burglary, one felony count of conspiracy and one misdemeanor count of petit larceny.

Joshua Glen Black, 32, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of possession with intent to deliver a controlled substance, one felony count of conspiracy and one misdemeanor count of knowingly maintaining a dwelling, building or other structure or place for the purpose of using or selling controlled substances.

Clayton Dale Kimble, 32, of Elkins, was indicted on one felony count of possession with intent to deliver a controlled substance, one felony count of conspiracy and one misdemeanor count of knowingly maintaining a dwelling, building or other structure or place for the purpose of using or selling controlled substances.

Brandin Forrest Carr, 32, of Harman was indicted on one felony count of possession with intent to deliver, one felony count of conspiracy and one misdemeanor count of possession by prohibited person of a firearm.

Matthew Dale Channel, 32, was indicted on one felony count of fleeing in a vehicle with reckless disregard, one felony count of attempted unlawful assault upon an officer, one misdemeanor count of fleeing from an officer by any means other than the use of a vehicle, one misdemeanor count of receiving stolen goods, one misdemeanor count of driving while license revoked for DUI, one misdemeanor count of false information, one misdemeanor count of improper registration, one misdemeanor count of reckless driving and one misdemeanor count of no insurance.

Ryan Neil Coberly, 29, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of robbery in the first degree, one felony count of conspiracy, one felony count of use or presentation of a firearm during commission of a felony and one count of wanton endangerment involving a firearm.

John Paul Henderson, III, 32, of Elkins, was indicted on one felony count of robbery in the first degree and one felony count of conspiracy.

Melanie Michelle Evans, 39, an inmate at Tygart Valley Regional Jail, was indicted on five felony counts of forgery and five felony counts of uttering.

Joshua Matthew Hedrick, 33, an inmate at Tygart Valley Regional Jail, was indicted on three felony counts of possession with intent to deliver a controlled substance.

In a separate and unrelated incident, Hedrick was indicted on one felony count of possession of a controlled substance by an inmate.

Matthew Ray Hollen, 38, of Philippi, was indicted on one felony count of driving under the influence causing serious bodily injury, one felony count of retaliation against a public official or employee, one felony count of leaving the scene of a crash involving serious bodily injury and one misdemeanor count of reckless driving.

Jonathan Wesly Larkin, 33, of Mabie, was indicted on one felony count of receiving stolen goods and one felony count of cultivation of marijuana.

Jason Andrew Lindsay, 26, an inmate at Tygart Valley Regional Jail, was indicted on three felony counts of sexual assault in the third degree.

Kristopher James Love, 32, an inmate at St. Mary's Correctional Center and Jail, was indicted on one felony count of transportation of controlled substances onto the grounds of a correctional facility, one felony count of offense committed by an inmate and one felony count of conspiracy.

Allison Kate Frame, 32, of Clay, was indicted on one felony count of transportation of controlled substances onto the grounds of a correctional facility, one felony count of attempted delivery of contraband to an inmate and one felony count of conspiracy.

Charles William Mauller, 33, an inmate at Eastern Regional Jail, was indicted on one felony count of malicious assault upon a correctional employee and one felony count of offense committed by an inmate.

Clinton Dale McCauley, 28, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of fleeing in a vehicle with reckless disregard, one misdemeanor count of fleeing from an officer by any means other than the use of a vehicle, one misdemeanor count of reckless driving and one misdemeanor count of operating a motor vehicle exceeding speed limitations.

Trevor William Mitchell, 23, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of material depicting a minor engaged in sexually explicit conduct, five felony counts of use of minors in filming sexually explicit conduct and five felony counts of employment or use of minor to produce obscene matter.

Edward Alvin Morton, 66, an inmate at Mount Olive Correctional Center, was indicted on one felony count of escape by persons in custody of institutions or officers.

Kevin Michael Phillips, 54, an inmate at Northern Correctional Center, was indicted on one felony count of threats of terrorist acts.

Cody Tyler Pudder, 26, an inmate at Potomac Highlands Regional Jail, was indicted on one felony count of malicious assault upon a correctional employee and one felony count of offense committed by an inmate.

Christopher Michael Rosier, 33, an inmate at Tygart Valley Regional Jail, was indicted on two felony counts of possession with intent to deliver a controlled substance, two misdemeanor counts of battery upon a law enforcement officer and one misdemeanor count of destruction of property.

Martin Shane Roy, 43, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of sexual assault in the third degree, one felony count of sexual assault in the second degree and one felony count of sexual abuse by a parent, guardian, custodian or person in a position of trust to a child.

Erica Diane Sharp, 40, an inmate at Tygart Valley Regional Jail, was indicted on three felony counts of child neglect creating risk of serious bodily injury or death.

Jonathan William Streets, 24, an inmate at Martinsburg Correctional Facility, was indicted on one felony count of malicious assault, one felony count of offense committed by an inmate and one felony count of conspiracy.

Kelly Lynn Becker, 40, an inmate at Tygart Valley Regional Jail, was indicted on two felony counts of possession with intent to deliver a controlled substance and one felony count of failure to appear in court.

Jacob Isaac Reed, 26, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of malicious assault, one felony count of offense committed by an inmate and one felony count of conspiracy.

Daniel Walter Swanson, 55, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of failure to register as a sexual offender or provide notice of registration changes, second or subsequent offense.

Matthew Wayne Taylor, 27, an inmate at Tygart Valley Regional Jail, was indicted on two felony counts of sexual assault in the third degree.

Donna Lynn Wilfong, 46, of Elkins, was indicted on one felony count of possession with intent to deliver a controlled substance and one misdemeanor count of possession of a controlled substance.

Shawn David Wilson, 34, an inmate at Tygart Valley Regional Jail, was indicted on one felony count of possession with intent to deliver a controlled substance.

Thomas Richard Withers, 47, of Coalton, was indicted on one felony count of cultivation of marijuana.
