BUCKHANNON -- A Crawford man was arrested for several charges after allegedly being found overdosing in his vehicle twice during recent months.
Zachary A. McCartney, 27, of Crawford was arrested for possession of a controlled substance, a misdemeanor from the April 12 incident and possession of a controlled substance with intent to deliver, a felony; and unlawful manufacture, delivery or possession of fentanyl, a felony, for the charges from the Feb. 3 incident, according to the criminal complaints from the Upshur County Magistrate Clerk's office.
On April 12, Trooper J.S. Tonkin with the Buckhannon detachment of the West Virginia State Police, responded to Valley Green for an unresponsive individual, later identified as McCartney, slumped over in the driver's seat of a blue Ford Escape, according to the criminal complaint.
Tonkin observed a tin container in the center console with packaging consistent with that of heroin stamps as well as a piece of folded aluminum foil with a back burn trail. Tonkin stated the foil is consistent with smoking of pills or powder narcotics, according to the criminal complaint.
McCartney was removed form the vehicle and checked by Upshur County EMS but refused further treatment. Tonkin then learned of the two active warrants from the Feb. 3 incident, the complaint states. Upon a search of the vehicle, Tonkin found four round blue pills identified as Clonazepam.
On Feb. 3, McCartney was spotted slumped over his vehicle behind Middleton Hall on the campus of West Virginia Wesleyan College. McCartney allegedly had about 40 stamps of heroin which he stated also contained fentanyl on Feb. 3, according to the criminal complaint in the Upshur County Magistrate Clerk's office. A baggie with a small amount of meth was also located.
Lt. Doug Loudin with the Buckhannon Police Department responded to the overdose call and met with Upshur County EMS and Buckhannon Fire Department firefighters who advised that McCartney had a black bag with foil in it that they believed to contain heroin. McCartney had a snort straw on his lap as well and the items had been moved so they could treat McCartney. Loudin noticed the heroin stamps on the driver's seat where McCartney was sitting. McCartney refused to give Loudin consent to search the vehicle but stated that he had allegedly used heroin around 8 a.m. that day and what was already found was laced with fentanyl. Emergency responders took McCartney to St. Joseph's Hospital.
Magistrate Kay Hurst set bond at $20,000 cash or surety for each of the two felonies and $5,000 cash or surety for the misdemeanor.
