BUCKHANNON -- Upshur County Sheriff's deputies caught two individuals allegedly returning to retrieve a stolen UTV they hid off of No. 5 Mine Hollow Road last week.
Timothy Lee Henry, 33, of Independence, was arraigned Wednesday, Nov. 4 before Upshur County Magistrate Kay Hurst for entering without breaking, grand larceny and conspiracy to commit felony, all felonies.
On Tuesday, Oct. 27, Sgt. C.B. Shrader and Senior Trooper P.J. Robinette with the Buckhannon detachment of the West Virginia State Police responded to 1295 Upper Pecks Run Rd. at 9:19 a.m. for a grand larceny complaint, according to the criminal complaint in the Upshur County Magistrate's office. Upon arrival, Robinette spoke with the victim, Travis Koon, who stated his UTV was stolen at approximately 4:15 a.m. according to security camera footage. The victim provided information showing the UTV cost $11,680.90 and also had a windshield, roof, winch and light bar which raised the value to over $13,000.
The security footage showed two individuals approaching the garage from behind and gaining entry into the garage through an unsecured door and are seen lifting the garage door a short time later.
"One individual is seen pushing the UTV out of the garage while one sits in the driver's seat," Robinette wrote in the criminal complaint. The second individual then got in the passenger seat and the UTV drove away.
Henry allegedly admitted to stealing the above mentioned UTV and stated he was accompanied by another individual who drove the UTV off of the property.
Hurst set bond at $30,000 cash or surety.
Entering without breaking carries confinement in the state penitentiary for one to 10 years while grand larceny carries confinement in the penitentiary for one to 10 years, or in the discretion of the court be confined in jail for up to one year and fined not more than $2,500. The penalty for conspiracy to commit felony carries confinement in the penitentiary for one to five years and/or up to a $10,000 fine.
Information on the second individual was not available Wednesday afternoon and it was not known if a second arrest had been made.
