Upshur grand jury hands down 28 indictments

BUCKHANNON — An Upshur County grand jury indicted a total of 28 individuals this week, including a Virginia man who allegedly gave police a false name when accused of shooting another man in the leg.

Lavar Anthony ONeal, 39, of Newport News, Virginia, originally gave the name of Marvin Sills to Upshur County Sheriff’s deputies and was arraigned and booked into jail under that name, according to the criminal complaint in the Upshur County Magistrate Clerk’s office. ONeal forged Sills name to the Upshur County Magistrate Court documents and uttered them to be his own.

ONeal was originally arrested for allegedly shooting Zachary Crawford in the leg and foot in December.

He was indicted this week on one count of malicious assault, a felony; three counts of forgery of a public record, all felonies; three counts of uttering a public record, all felonies; and one count of fleeing or attempting to flee by means other than use of a vehicle, a misdemeanor.

Also indicted this week were:

Joshua Ray Amelotte, 25, of Buckhannon, for possession with intent to deliver methamphetamine.

George Tyree Cottle, 37, of Dundee, Ohio, for destruction of property, a felony; and brandishing and fleeing on foot, both misdemeanors.

Michael Ray Fitzwater, 40, of Waynesburg, strangulation, two counts third-offense domestic assault, and two counts third-offense domestic battery, all felonies; separately, possession of a stolen vehicle and prohibited person in possession of a firearm, both felonies; and fleeing on foot, a misdemeanor.

Joshua Allen Frame, 21, of Crawford, second-or-subsequent offense failure to comply with sex offender registry law.

Silas Elliott Gain, 37, of Buckhannon, fleeing with reckless indifference.

Patrick Wayne Gower, 37, of Buckhannon, third-offense driving while license revoked for DUI.

John Jason Hamrick, 46, of Webster Springs, strangulation, a felony; and domestic battery and domestic assault, both misdemeanors.

Joseph Alexander Haislip, 28, of Buckhannon, wanton endangerment involving a firearm.

Jackie Lee Harris, 39, of Buckhannon, third-offense driving while license revoked for DUI.

Zachariah Tyler Helmick, 23, of Ireland, two counts grand larceny, two counts conspiracy.

Alexis Rae Quattro, 19, of Ireland, two counts grand larceny, two counts conspiracy.

Timothy Lee Henry, 34, of Independence, entry of a building other than a dwelling, grand larceny, conspiracy.

Jeffrey Andrew Saltis, 27, of Buckhannon, entry of a building other than a dwelling, grand larceny; separately, entry of a building other than a dwelling, grand larceny, conspiracy; separately, attempted grand larceny, entry of a building other than a dwelling, grand larceny.

Scottie Dale Hinchman, 41, of Adrian, grand larceny.

Katherine Ann Huffman, 43, of Buckhannon, worthless check.

John Edward Hull, 50, of Buckhannon, third-offense driving revoked for DUI, entry of a building other than a dwelling, petit larceny.

Colten Darrell Lester, 32, of Volga, for possession with intent to deliver methamphetamine, a felony; and first-offense driving while revoked for DUI and unlawful taking of a vehicle, both misdemeanors.

Robert Lee Moats, 41, of Buckhannon, for two counts first-degree sexual abuse, two counts sexual abuse by a parent, guardian, custodian or person in a position of trust.

William Thomas Peyatt, 21, of Buckhannon, for possession of a stolen vehicle.

Brandon Willard Scott, 35, of Buckhannon, for burglary and conspiracy, both felonies; and petit larceny, a misdemeanor.

Lita Angel Smallwood, 35, of Buckhannon, for burglary and conspiracy, both felonies; and petit larceny, a misdemeanor.

Khori Wayne Simmons, 25, of Buckhannon, for malicious assault, a felony; and brandishing, a misdemeanor.

Skybluewater Keys, 44, of Buckhannon, for seven counts Medicaid fraud, one count fraudulent scheme.

Corey David Tanner, 32, of Weston, second-offense unlawful taking of a vehicle, felony; and fleeing or attempt to flee by means other than vehicle, a misdemeanor.

Donald Eugene Taylor, 42, of Buckhannon, distribution and exhibiting of material depicting minors engaged in sexually explicit conduct.

Joshua Ryan Warner, 44, of Buckhannon, three counts forgery, three counts uttering.

James Ray Woodson, 31, of Selbyville, fleeing with reckless indifference, a felony; and first-offense driving while license revoked for DUI and fleeing or attempt to flee by means other than vehicle, both misdemeanors.
