BUCKHANNON -- A Buckhannon man has been arrested after allegedly being found sleeping on a couch in a home where he was told not to return.
Jerry Dunlavy, 26, was charged with burglary, a felony, and stalking, a misdemeanor, according to the criminal complaint in the Upshur County Magistrate Clerk's office.
On March 3, Lt. Marshall Powers and Deputy Seth Cutright with the Upshur County Sheriff's Department responded to a removal of an unwanted person at a home in French Creek. After arriving on scene, Cutright located Dunlavy in the house sleeping on the couch in the living room, according to the criminal complaint.
"I advised the defendant that he was not allowed on the property and removed the subject," Cutright said. "The subject entered the house through a garage door window and came through a locked basement door. We were also advised that the defendant took several knickknacks as well. We located the defendant's jacket in the house on the basement steps with a bottle of hydrocodone pills, bracelets and earrings."
Dunlavy was then found near the Alton Road and arrested on a warrant out of Lewis County, the complaint states, with a coin case containing one 50 cent piece, one quarter, one dime, one nickel, one penny, a U.S. pin medal and a USN pin medal, all taken from the house. Dunlavy has not lived or stayed at the house since Jan. 15, police said.
Magistrate Mark Davis set bond at $10,000.
Burglary carries imprisonment in a state correctional facility for one to 15 years and stalking carries confinement in jail for up to six months and/or a fine up to $1,000.
