Woman facing child abuse charge

ELKINS — A Valley Band woman is behind bars and accused of striking and scratching an 8-year-old boy.

Lacy Ann Evans, 37, is charged with child abuse resulting in injury, a felony. She is being held in the Tygart Valley Regional Jail on a $35,000 bond set by Magistrate Mike Dyer.

According to the criminal complaint, prepared by West Virginia State Trooper E.B. Malcomb, on Dec. 1, a health care provider reported an 8-year-old boy had physical injuries from being assaulted by Evans. The boy had “scratches on his chest and his neck.”

A witness told officers that, while in a car with Evans and the boy, Evans “got very angry, got out of her seat and started punching him while she held him down,” the complaint states. Evans allegedly said, “I just want to kill you” and “grabbed his neck and dug her nails into the skin.”

Malcomb wrote that he spoke to Evans on Dec. 3. She allegedly said that the boy had kicked her arm but she had not struck him. Malcomb wrote that he did not find Evans’ “statement consistent with the injuries” on the boy’s body.
