Randolph grand jury hands down 49 indictments

ELKINS -- A Randolph County grand jury handed down 49 indictments Monday involving 41 individuals.

The indictments involved alleged crimes including drug offenses, wanton endangerment involving a firearm and sexual abuse.

Brent Nikota Bittner, 19, an inmate at the Tygart Valley Regional Jail, was indicted on one count of distribution and display to minor of obscene matter, a felony, one count of use of obscene matter with intent to seduce a minor, a felony, one count of employment or use of a minor to produce obscene matter or assist in doing sexually explicit conduct, a felony, one count of use of minors in filming sexually explicit conduct, a felony, and one count of soliciting a minor via computer, a felony.

Walter James Bennett, 44, an inmate at the Tygart Valley Regional Jail, was indicted on one count of driving while license revoked for DUI, third offense.

Bennett was also named in a separate and unrelated indictment, indicted on two counts of wanton endangerment involving a firearm, a felony, and one count of retaliation against a public official or employee, a felony.

John Garrett Adkisson, 31, of Elkins, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of possession of fentanyl, a felony.

Bumper Paul Armstrong, Jr., 45, of Elkins, was indicted on one count of breaking and dntering, a felony, one count of petit larceny, a misdemeanor, and one count of possession of a controlled substance, a misdemeanor.

Peter Babala, Jr., 50, an inmate at the Tygart Valley Regional Jail, was indicted on three counts of failure to register as a sexual offender or provide notice of registration changes, a felony.

James Michael Barnes, 62, of Slatyfork, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of possession of a controlled substance, a misdemeanor.

Denver Franklin Bennett, 29, an inmate at the Tygart Valley Regional Jail, was indicted on one count of burglary, a felony, and one count of petit larceny, a misdemeanor.

Bennett was also named in a separate and unrelated indictment, indicted on one count of receiving stolen goods, a felony, one count of fleeing in a vehicle with reckless indifference, a felony, and one count of fleeing from an officer by any means other than the use of a vehicle, a misdemeanor.

John David Channell, 26, of Valley Bend, was indicted on one count of distribution and display to a minor of obscene matter, a felony, and one count of use of obscene matter with intent to seduce a minor, a felony.

Joshua Thomas Copella, 41, an inmate at the Tygart Valley Regional Jail, was indicted on one count of burglary, a felony, and one count of grand larceny, a felony.

Copella was also named in a separate and unrelated incidment, indicted on three counts of failure to register as a sexual offender or provide notice of tegistration changes, second or subsequent offense, a felony.

Dennis Clayton Currence, 42, an inmate at the Tygart Valley Regional Jail, was indicted on one count of burglary, a felony, one count of grand larceny, a felony, and one count of conspiracy, a felony.

William Thomas Desantis, 31, an inmate at the Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony.

Desantis was also named in a separate and unrelated indictment, indicted on one count of transportation of controlled substances onto the grounds of a correctional facility, a felony, and one count of possession of a controlled substance by an inmate, a felony.

Jerimiah Lee Evix, 40, an inmate at the Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Telicia Rae Evix, 40, an inmate at Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Stevie Drew Fox, 34, of Mill Creek, was indicted on one count of fleeing in a vehicle with reckless indifference, a felony, one count of fleeing in a vehicle while driving under the influence, a felony, and two counts of battery upon a law enforcement officer, a misdemeanor.

Fox was also named in a separate and unrelated indictment, indicted on one count of grand larceny, a felony, and one count of possession of a stolen vehicle, a felony.

Gail Wilson Gear, 68, of Mill Creek, was indicted on one count of failure to register as a sexual offender or provide notice of registration changes, a felony.

Hunter Miller Howell, 51, of Elkins, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of driving while license revoked for DUI, third offense, a felony.

Jennifer Fay Lambert, 34, an inmate at the Tygart Valley Regional Jail, was indicted on one count of shoplifting, third offense, a felony.

In a separate and unrelated indictment, Lambert was indicted on one count of shoplifting, third offense, a felony.

Stephen Blake Landis, 54, an inmate at the Potamac Highlands Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Ashley Nicole Bauer, 36, of Philippi, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Tara Lynn Leary, 32, an inmate at the Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony.

Kristopher James Love, 34, an inmate of Huttonsville Correctional Center, was indicted on one count of possession of a controlled substance by an inmate, a felony, and one count of offense committed by an inmate, a felony.

Dakota Lynn Marco, 20, of Elkins, was indicted on one count of distribution and display to a minor of obscene matter, a felony, and one count of use of obscene matter with intent to seduce a minor.

In a separate and unrelated indictment, Marco was indicted on one count of burglary, a felony, two counts of grand larceny, a felony, and two counts of fraudulent use of an access device, a felony.

Joseph Ray Maxwell, 34, an inmate at the Tygart Valley Regional Jail, was indicted on one count of shoplifting, third offense, a felony.

Keith Odell McCourt, 52, an inmate at the Tygart Calley Regional Jail, was indicted on two counts of failure to register as a sexual offender or provide notice of registration changes, second or subsequent offense, a felony.

Valerie Jacque McIntyre, 33, of Elkins, was indicted on two counts of counterfeiting, a felony.

Steven Bernard Miller, 48, an inmate at the Tygart Valley Regional Jail, was indicted on two counts of failure to register as a sexual offender or provide notice of registration changes, a felony.

Jessica Nicol Poe, 33, an inmate at the Tygart Valley Regional Jail, was indicted on two counts of failure to register as a person convicted of child abuse or neglect or provide notice of registration changes, second or subsequent offense, a felony.

Keith Allen Poteete, 56, of Elkins, was indicted on one count of possession with intent to deliver a controlled substance, a felony.

Richard Lee Ryan, 59, an inmate at the Tygart Valley Regional Jail, was indicted on two counts of failure to register as a sexual offender or provide notice of registration changes, second or subsequent offense, a felony.

In a separate and unrelated indictment, Ryan was indicted on two counts of failure to register as a sexual offender or provide notice of registration changes, second or subsequent offense, a felony.

Cody Wallis Sendline, 22, of Beverly, was indicted on one count of fleeing in a vehicle with reckless indifference, a felony, one count of domestic battery, a misdemeanor, and one count of destruction of property, a misdemeanor.

Wallis Charles Sendling, Jr., 44, an inmate at the Tygart Valley Regional Jail, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, one count of conspiracy, a felony, and 17 counts of possession by a prohibited person of a firearm, a misdemeanor.

Miranda Marie Arbogast, 32, of Beverly, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Andrew Coleman Storey, 31, an inmate at the Tygart Valley Regional Jail, was indicted on one count of burglary, a felony, one count of destruction of property, a misdemeanor, and one count of failure to appear, a felony.

Luis Manuel Torres-Serrano, 39, an inmate at the Tygart Valley Regional Jail, was indicted on three counts of sexual assault in the first degree, a felony, 11 counts of sexual abuse by a parent, guardian, custodian, or person in a position of trust to a child, a felony, eight counts of sexual abuse in the first degree, a felony, two counts of unlawful assault, a felony, 33 counts of child abuse resulting in bodily injury, a felony, one count of strangulation, a felony, and one count of child neglect creating risk of serious bodily injury or death, a felony.

Rosemary Nicole McClearen, 38, of Elkins, was indicted on seven counts of child neglect creating risk of serious bodily injury or death, a felony, and one count of child abuse resulting in bodily injury, a felony.

Richard Wayne Walters, Jr., 40, an inmate at the Tygart Valley Regional Jail, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of possession of fentanyl, a felony.

Roger Lee Ware, 44, an inmate at the Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Eric Lynn Armstrong, 38, an inmate at the Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Krystal Ann Dellagata, 31, an inmate at the Tygart Valley Regional Jail, was indicted on one count of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Marc David West, 32, an inmate at the Southwestern Regional Jail, was indicted on two counts of transportation of controlled substances onto the grounds of a correctional facility, a felony, and two counts of possession of a controlled substance by an inmate, a felony.

Joshua Paul Woods, 29, an inmate at the Tygart Valley Regional Jail, was indicted on one count of fleeing in a vehicle with reckless indifference, a felony.

Bond return for the indictments returned by the February 2022 term of the Randolph County Grand Jury will be at 1:30 p.m. March 9, at which time bond will be set and trial dates will be determined.

The fact that a defendant has been charged with a crime is merely an accusation and all defendants are presumed innocent until and unless proven guilty.
