ELKINS -- An Elkins man has been accused of allegedly requesting sexual material from a Barbour County juvenile.
Jaymes Richard Arbogast, 29, is being charged with a felony count of soliciting a minor via computer.
According to a criminal complaint filed in Barbour County by West Virginia State Police Senior Trooper B.S. Stout, on June 30, Stout was advised that Arbogast was allegedly soliciting a minor for pictures and sex, who he knew to be underage.
The complaint states Stout confirmed the juvenile was 15 years old when they were receiving the messages. Stout observed the messages on the alleged victim's phone and confirmed the messages came from an electronic device owned by Arbogast.
"This officer was advised that Mr. Arbogast had sent an audio recording via Facebook Messenger and stated that he knew that he should not have messaged the victim," Stout writes in the complaint.
If convicted, Arbogast could face a fine of not more than $5,000 or be imprisoned in a state correctional facility for two to 10 years, or both.
