ELKINS -- A Chenoweth Creek Road man was indicted for murder Monday by a Randolph County grand jury, one of 39 individuals named in indictments.
Stephen Ray Cross, 55, currently an inmate at Tygart Valley Regional Jail, was indicted on one count of murder, and one felony count of use or presentation of a firearm during commission of a felony.
On March 27, Cross was taken into custody after a shooting that took the life of Jonathan Chenoweth.
According to the criminal complaint, Cross shot Chenoweth, who was unarmed, after Chenoweth pulled into Cross's driveway in a UTV.
A witness told police that Chenoweth was upset with Cross for shooting a dog.
Also indicted Monday:
Derrick Rashawn Austin, 34, an inmate at Tygart Valley Regional Jail, was indicted on one count of stalking in violation of protective order, a felony; three counts of harassment in violation of protective order, a felony; and four counts of attempted violation of a protective order, a misdemeanor.
Crystal Lee Bennett, 39, of Huttonsville, was indicted on one count of grand larceny, a felony.
Darin Joseph Brooks, 35, of Elkins, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.
Steven John Kacenski, 53, of Myrtle Beach, South Carolina, was indicted on two counts of possession with intent to deliver a controlled substance, a felony; and one count of conspiracy, a felony.
Milton Theodore Broseker III, 56, an inmate at Tygart Valley Regional Jail, was indicted on one count of driving under the influence of alcohol, third or subsequent offense, a felony; one count of driving while license revoked for DUI, a misdemeanor; and one count of failure to maintain control, a misdemeanor.
Henry David Cottrell, 61, of Montrose, was indicted on two counts of wanton endangerment involving a firearm, a felony.
Heath Jarrett Elder, 46, an inmate at Tygart Valley Regional Jail, was indicted on four counts of shoplifting, third offense, a felony.
Gregory Lee Howell, 37, an inmate at Tygart Valley Regional Jail, was indicted on one count of burglary, a felony; one count of grand larceny, a felony; one count of conspiracy, a felony; and one count of disinterment or displacement of dead body or parts thereof, a felony.
Landon Kane Jenkins, 34. of Belington, was indicted on one count of embezzlement, a felony, and one count of conspiracy, a felony.
Cynthia Jewel Williams 35, of Belington, was indicted one count of embezzlement, a felony, and one count of conspiracy, a felony.
Charles Earl Jones III, 39, an inmate at Stevens Correctional Center, Industrial, was indicted on one count of fleeing in a vehicle with reckless indifference, a felony, and one count of feeing from an officer by any means other than the use of a vehicle, misdemeanor.
Amber Ann Keener, 34, an inmate at Tygart Valley Regional Jail, was indicted on one count of fleeing in a vehicle with reckless indifference, a felony, and one count of driving while license revoked for DUI, third offense, a felony.
Patricia Lynn Lindsay, 39, of Valley Head, was indicted on one count of failure to register as a sexual offender or provide notice of registration changes, a felony.
Christopher George Lyle, 41, of Junior, was indicted on one count of driving while license revoked for DUI, third offense, a felony.
Billy Joe McCune Jr., 43, of Mill Creek, was indicted on one count of driving while license revoked for DUI, third or subsequent offense, a felony; one count of no registration, a misdemeanor; and one count of possession of a controlled substance, a misdemeanor.
Timothy Roy McDonald, 61, of Elkins, was indicted on one count of arson in the first degree, a felony.
Courtney Paige McGee, 24, an inmate at Tygart Valley Regional Jail, was indicted on one count of transportation of controlled substances onto the grounds of a correctional facility, a felony, and one count of possession of a controlled substance by inmate, a felony.
In a separate and unrelated indictment, McGee was indicted on two counts of possession with intent to deliver a controlled substance, a felony.
Samantha Renee Oldaker, 27, an inmate at Tygart Valley Regional Jail, was indicted on one count of child abuse resulting in bodily injury, a felony; one count of child neglect resulting in bodily injury, a felony; and five counts of child neglect creating risk of injury, a misdemeanor.
Joseph Paul Peters, 32, of Elkins, was indicted on one count of child neglect resulting in bodily injury, a felony; one count of child neglect resulting in bodily injury, a felony; and five counts of child neglect creating risk of injury, a misdemeanor.
Justin Bryant Pennington, 33, an inmate at Tygart Valley Regional Jail, Belington, was indicted on one count of burglary, a felony, and one count of indecent exposure, a misdemeanor.
Christopher Bryan Pingley, 48, of Beverly, was indicted on one count of breaking and entering, a felony; one count of conspiracy, a felony; one count of petit larceny, a misdemeanor; and one count of destruction of property, a misdemeanor.

Brent Allen Shiflett, 33, an inmate at the Tygart Valley Regional Jail, Belington, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.
Megan Marie Floyd, 31, of Elkins, was indicted on two counts of possession with intent to deliver a controlled substance, a felony, and one count of conspiracy, a felony.

Bond Return for the indictments returned by the October 2023 term of the Randolph County Grand Jury will be on Monday, Nov. 6 at 1:30 p.m., at which time bond will be set and trial dates will be determined.
The fact that a defendant has been charged with a crime is merely an accusation and all defendants are presumed innocent until and unless proven guilty.
