ELKINS -- A man is facing a felony charge after allegedly shoplifting from a local convenience store.
Joseph Ray Maxwell, 37, has been charged with shoplifting - third offense, a felony. He is being held in the Tygart Valley Regional Jail on a $3,000 cash bond set by Randolph County Magistrate Mike Dyer.
According to the criminal complaint, prepared by Patrolman J.H. White of the Elkins Police Department, on Dec. 28 at approximately 8 p.m., officers responded to Speedway on Harrison Avenue for a report of "a male individual shoving items in his pockets without paying, as well as acting high and causing a disturbance."
Officers observed a man in the parking lot "with a black jacket that had pockets overflowing with cans of Red Bull and other food items," complaint states.
The man, Maxwell, "had several food items, drinks and clothing items concealed on his person," but no receipt, according to the complaint. The items taken from the store totaled $121.80, police said.
Maxwell has a previous conviction for shoplifting - second offense in January of 2021, the complaint states.
