Upshur County Grand Jury indicts 40 people

BUCKHANNON -- An Upshur County Grand Jury returned indictments against 40 individuals Tuesday, for alleged crimes including delivery of a controlled substance, fleeing in a vehicle with reckless indifference to the safety of others, and gross child neglect creating serious risk of death or serious bodily injury.

Greg Robert Tenney, 23, of Rock Cave, was indicted on one felony count of possession of a Controlled Substance with the Intent to Deliver; and one felony count of Conspiracy to Violate Chapter 60A, Article 4, Section 401 of the W.Va. Code.

Beverly Ann Helmick, 46, of Volga, was indicted on one felony count of delivery of a controlled substance.

Dakota Shane Kahlbaugh, 21, of French Creek, was indicted on four felony counts of Fraudulent Use of an Access Device; one misdemeanor count of Tampering with an Automobile; one misdemeanor count of petit larceny; and one misdemeanor count of Conspiracy.

Robert William Smith, 43, of Buckhannon, was indicted on one felony count of domestic battery -- third offense; and one misdemeanor count of violation of a protective order.

Timothy Edward Wilson, 43, of French Creek, was indicted on one felony count of fleeing in a vehicle with reckless indifference to the safety of others; one misdemeanor count of no insurance; and one misdemeanor count of no registration.

John Edwin White, 49, of Clarksburg, was indicted on one felony count of grand larceny; and one felony count of conspiracy.

Joshua Edwin White, 28, of Anmoore, was indicted on one felony count of grand larceny; and one felony count of conspiracy.

Joshua Eugene Bean, 27, of Buckhannon, was indicted on one felony count of child neglect resulting in injury; and one felony count of gross child neglect creating serious risk of death or serious bodily injury.

Michelle Dawn Bean, 21, of Buckhannon, was indicted on one felony count of child neglect resulting in injury; and one felony count of gross child neglect creating serious risk of death or serious bodily injury.

Michelle Lee Tomey, 28, of Buckhannon, was indicted on one felony count of grand larceny; one felony count of entry of a building other than a dwelling; and one felony count of conspiracy.

Edward Lee Lane, 36, of Walkersvlille, was indicted on two felony counts of gross child neglect creating a substantial risk of death or serious bodily injury; one misdemeanor count of domestic battery; and one misdemeanor count of domestic assault.

Travis M. Starkey, 29, of Buckhannon, was indicted on two felony counts of burglary; two felony counts of grand larceny; and two felony counts of conspiracy.

Katie Elizabeth Grogg, 27, of Buckhannon, was indicted on two felony counts of burglary; two felony counts of grand larceny; and two felony counts of conspiracy.

William Jason Butcher, 45, of Buckhannon, was indicted on one felony count of gross child neglect creating substantial risk of death or serious bodily injury; and one misdemeanor count of animal cruelty.

Katrina Lynn Hall, 38, of Buckhannon, was indicted on felony count of gross child neglect creating substantial risk of death or serious bodily injury; and one misdemeanor count of animal cruelty.

Corey James Wells, 29, of Buckhannon, was indicted on one felony count of fleeing in a vehicle with reckless indifference to the safety of others; and one misdemeanor count of fleeing by means other than the use of a vehicle, a misdemeanor.

Steven Dewayne Arbogast, 42, of Buckhannon, was indicted on two felony counts of retaliation against a public official.

Jessicanna Darlene Bennett, 42, of Buckhannon, was indicted on two felony counts of possession of a controlled substance with the intent to deliver; and one felony count of conspiracy to violate Chapter 60A, Article 4, Section 401 of the W.Va. Code.

Steven James Riffle, 32, of Buckhannon, was indicted on one felony count of delivery of a controlled narcotic substance; and one felony count of conspiracy to violate Chapter 60A, Article 4, Section 401 of the West Virginia State Code.

Larry Wayne Gregory, 58, Buckhannon, was indicted on one felony count of fleeing with reckless indifference to the safety of others; and single misdemeanor counts of fleeing by means other than the use of a vehicle, obstructing an officer, and possession of a controlled substance.

Joseph Patrick Herron, 40, of Buckhannon, was indicted on one felony count of driving while license revoked for DUI, 3rd or subsequent offense.

Kelcee Kaye Fortney, 27, of Buckhannon, was indicted on two felony counts of computer fraud; and one felony count of financial exploitation of an elderly person.

Robert Lee Stout, 41, of Buckhannon, was indicted on one felony count of battery on a law enforcement officer, 2nd or subsequent offense; and single misdemeanor counts of petit larceny, possession of a controlled substance, and fleeing by means other than the use of a vehicle.

Carol Lynn Fincham, 51, of Buckhannon, was indicted on one felony count of retaliation against a public employee; and single misdemeanor counts of driving while license revoked for DUI, driving while in an impaired state – second offense, and attempted battery on a law enforcement officer.

Arista Danielle Wright, 25, of Buckhannon, was indicted on one felony count of drug delivery resulting in death; and one felony count of conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code.

Elizabeth Ann Marks, 33, of French Creek, was indicted on one felony count of gross child neglect creating a substantial risk of death or serious bodily injury; and single misdemeanor counts of driving under the influence of controlled substances and proximately causing bodily injury, driving under the influence of controlled substances with an unemancipated minor, and no insurance.

Joshua James Endicott, 40, Buckhannon, was indicted on three felony counts of failure to provide notice of a change to required sex offender registration information, lifetime registrant – second offense.

Israel Justin Tenney, 39, of Buckhannon, was indicted on three felony counts of fraudulent use of an access device; and one felony count of attempted fraudulent use of an access device.

Jessica Louise Tenney, 29, of Buckhannon, was indicted on two felony counts of gross child neglect creating a substantial risk of death or serious bodily injury.

Clinton Earl Walton, 38, of Buckhannon, was indicted on 35 felony counts of sexual assault in the second degree.

Timothy Wayne Loudin, 62, of Tallmansville, was indicted on four felony counts of sexual abuse by a parent, guardian, custodian, or person in position of trust to a child; and four felony counts sexual abuse in the first degree.

James Edward Williams, Jr., 52, of Detroit, Michigan, was indicted on two felony counts of grand larceny; and one felony count of destruction of property.

Corey David Tanner, 35, of Weston, was indicted on one felony count of fleeing in a vehicle with reckless indifference to the safety of others; one felony count of fleeing in a vehicle while under the influence of controlled substances; one misdemeanor count of driving while license suspended, third or subsequent offense; one felony count of escape from custody; one misdemeanor count of possession of a controlled substance; two misdemeanor counts of obstructing an officer; one misdemeanor count of fleeing by means other than the use of a vehicle; one felony count of burglary; and one misdemeanor count of battery.

Dereck Adam Cobb, 33, of French Creek, was indicted on five felony count of prohibited person in possession of a firearm; and one felony count of receiving or transferring stolen goods.

Samuel Edgar Jones, 31, of Buckhannon, was indicted on two felony count of arson in the fourth degree; and four misdemeanor counts of domestic assault.

Bobby Joe Thompson, 41, of Buckhannon, was indicted on one felony count of possession of a controlled narcotic substance with the intent to deliver; one felony count of delivery of a controlled narcotic substance; one felony count of conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code; and one felony count of prohibited person in possession of a firearm.

Rachele Louise Thompson, 38, of Buckhannon, was indicted on two felony counts of delivery of a controlled narcotic substance; and one felony count of conspiracy to commit a violation of chapter 60a, article 4, section 401 of the west virginia code.

Alice Lenora Linger, 50, of Tallmansville, was indicted on one felony count of gross child neglect creating substantial risk of death or serious bodily injury; seven misdemeanor counts of animal cruelty; creating, and one misdemeanor count of contributing to, or operating an open dump.

Brandon Matthew King, 42, of Buckhannon, was indicted on two felony counts of retaliation against a public employee; one misdemeanor count of brandishing a firearm or other deadly weapon; and one misdemeanor count of obstructing an officer.

Clayton Dale Kimble, 36, of Tallmansville, was indicted on one felony count of distribution and exhibiting of material depicting a minor engaged in sexually explicit conduct.

Upshur County Prosecutor Bryan Hinkle's office stresses that an indictment is merely an accusation. All defendants are presumed innocent unless and until proven guilty.
