MILL CREEK -- A Randolph County man who was accused of repeatedly stomping on a woman's head entered a plea agreement this week.
Everett Junior Hall, 62, of Mill Creek, in accordance with the plea agreement, pled guilty to unlawful assault, a felony, in Randolph County Circuit Court on Feb. 5. He could be sentenced to one to five years in prison.
Hall was initially indicted by a grand jury on one count of malicious assault, a felony, and one count of domestic battery, a misdemeanor.
According to Assistant Randolph County Prosecutor Richard Shryock, on Nov. 1, 2023, West Virginia State Trooper N.R. Hall responded to a domestic call on Beechnut Drive in Mill Creek and observed Everett Hall standing in front of the victim. The victim had "visible blood on her face as well as a laceration underneath her right eye."
The victim and a witness identified Everett Hall as the attacker, Shryock said. The victim advised Trooper Hall that Everett Hall had hit something with his vehicle and, after the victim exited the home to ask him what he had hit, Hall grabbed her by the arm.
After pulling away from him, the victim stated that she went back inside the home and was chased up the stairs by Everett Hall into the upstairs bedroom, Shyrock said. The victim then said Everett Hall pulled her off the bed, causing her to fall on the floor and hit her head.
"(The victim) advised the officer at this time that Mr. Hall began stomping on her face," Shryock told the court. "Advising the undersigned officer that Mr. Hall stomped her head approximately five or six times. She did advise he had shoes on at the time."
When asked by Judge Jaymie Godwin Wilfong to explain what happened on Nov. 1, 2023, Everett Hall hesitated.
"This is hard for me," Everett Hall said. "We had some issues with drugs... But I was trying to prevent her from further use... and I tried to prevent her from the use of drugs. It got out of hand, and I just lost control. She was hurt and, in the end, so was I emotionally, because that's my wife."
Everett Hall said there initially was a struggle and he admitted to holding the victim down with his foot so he "could talk to her." He also admitted to kicking the victim.
Wilfong then asked Hall where he had kicked her and he admitted that it was in the head. After being questioned further by Wilfong about whether he had stomped on the victim's head five or six times, Hall said yes.
Hall will be sentenced on March 20 at 9 a.m.
