BUCKHANNON -- Police investigating a report of two men slumped over inside a car in a convenience store parking lot led to a drug felony arrest.
Joseph Michael Wagner, 42, is charged with possession with intent, a felony, and driving under the influence of a controlled substance, a misdemeanor. He is being held in the Tygart Valley Regional Jail on a $55,000 cash bond.
According to the criminal complaint, prepared by Patrolman Dylan Ray Major of the Buckhannon Police Department, on April 19, the officer responded to Sheetz in Buckhannon in reference to a suspicious vehicle/person. A Sheetz employee told the officer there were "two guys slumped over inside a parked vehicle."
Major approached a gray Dodge Dart and knocked on the window multiple times, the complaint states. Wagner, the driver, "woke up," while another officer woke the male passenger. Officers advised them to "put the vehicle in park," and Wagner got out of the car, showing "signs of impairment."
Another officer noticed a "blue wax stamp with the marking 'No Events' on the center console" of the car, according to the complaint. Major "administered ARIDE (Advanced Roadside Impaired Driving Enforcement)" on Wagner, and then "placed him in custody for DUI."
While searching Wagner's person, Major "located two 'buns' containing 20 individual blue wax stamps with the marking 'No Events,'" the complaint states. "The blue was stamps later tested positive for fentanyl," the officer wrote.
Another officer "located the same blue wax stamps with the marking 'No Events'" inside the passenger's backpack in the passenger seat of the vehicle, according to the complaint.
"After completing all of the ARIDE tests that were administered I asked Mr. Wagner if and when was the last time he used any drugs and he advised me about two hours ago," Major wrote. "I then asked him what did he use/take and he said, 'fentanyl.'"
