BUCKHANNON – A total of 27 individuals were indicted Monday by an Upshur County Grand Jury, for charges including attempted murder, DUI causing death and arson.

Dustyn Linn Walton, 29, of Tallmansville, was indicted for attempted murder and malicious assault, both felonies.

Brittany Hope Hurst, 34, of Buckhannon, was indicted for four counts of arson in the second degree, arson in the third degree, and three counts of destruction of property, all felonies.

Woodie Thomas Cole II, 45, of Audra, was indicted for strangulation, burglary and child abuse resulting in injury, all felonies; and domestic battery, second offense, a misdemeanor.

Joshua Barton Foster, 34, of West Milford, was indicted for DUI causing death, a felony, and aggravated DUI, a misdemeanor.

Emily Page Spracklen-Hamner, 37, of Buckhannon, was indicted for malicious wounding, a felony; two counts of assault, a misdemeanor; and brandishing a deadly weapon, a misdemeanor.

Landon James Kincaid, 20, of Buckhannon, was indicted for intimidation or harassment of a witness, a felony.

Jeffrey Scott Chapman, 40, of French Creek, was indicted for gross child neglect creating substantial risk of death or serious bodily injury, a felony, and domestic battery, a misdemeanor.

Chapman, of French Creek, was separately indicted for entry of a building other than a dwelling and grand larceny, both felonies.

Joseph Ryan Lane, 35, of Crawford, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, and no insurance, a misdemeanor.

Colten Darrell Lester, 36, of Buckhannon, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony.

Justin David Rogers, 43, of Buckhannon, was indicted for obtaining money by false pretenses, a felony.

Jeremy Wade Ables, 40, of Weston, was indicted for shoplifting, third offense, a felony.

Kristy Dawn Heckler, 28, of Hambleton, was indicted for battery on a law-enforcement officer, second offense, a felony; and obstructing an officer and disorderly conduct, both misdemeanors.

Trayka Faye Hinchman, 23, of Buckhannon, was indicted for two counts of delivery of a controlled substance, methamphetamine, a felony.

Kashia Marie Williams, 34, of Buckhannon, was indicted for conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, and delivery of a controlled substance, methamphetamine, both felonies.

Tellie Gene Gibson, 52, of Buckhannon, and Christopher Robert Taylor, 50, of Tallmansville, were both named in an indictment for burglary and conspiracy, both felonies.

Jeremiah Michael Burkhammer, 19, of French Creek, was indicted for suffocation and three counts of gross child neglect creating substantial risk of death or serious bodily injury, both felonies.

Debbie Lynn Perrine, 36, of Rock Cave, was indicted for gross child neglect creating substantial risk of death or serious bodily injury, a felony; possession of a controlled substance, methamphetamine, a misdemeanor; driving under the influence of controlled substances, a misdemeanor; and possession of a controlled substance, marijuana, a misdemeanor.

Liam Benjamin Roby, 19, of French Creek, was indicted for three counts of distribution and display to a minor of obscene matter, and two counts of intimidation of a public employee, both felonies.

Benjamin James Dickerson, 38, of Buckhannon, was indicted for two counts of receiving or transferring stolen goods, and two counts of conspiracy, both felonies.

Samantha Kelly Dickerson, 33, of Buckhannon, was indicted for grand larceny and conspiracy, both felonies.

Ronald Lee Winneberger, 55, of Buckhannon, was indicted for possession of a controlled substance with intent to deliver, methamphetamine, possession of a controlled substance with intent to deliver, marijuana, and conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, all felonies; and being a prohibited person in possession of a firearm, a misdemeanor.

James Benton Simons, 54, of Buckhannon, was indicted for prohibited person in possession of a concealed firearm, wanton endangerment involving a firearm, both felonies; and three counts of prohibited person in possession of a firearm, and possession of a controlled substance, methamphetamine, both misdemeanors.

Patrick Bryan Stafford, 42, of Buckhannon, was indicted for two counts of domestic battery, third or subsequent offense, and intimidation of a witness, both felonies.

Mikela Marie Mitchell, 40, of French Creek, was indicted for two counts of embezzlement, a felony.

Mitchell was separately indicted for 10 counts of grand larceny, and two counts of petit larceny, both felonies.

Jonathon John Herron, 39, of Buckhannon, was indicted for three counts of failure to provide notice of a change to required sex-offender registration information, life registrant, second offense, a felony.

Jamie Lynn Lee, 43, of Buckhannon, was indicted for burglary, a felony, and petit larceny, a misdemeanor.

An indictment is merely an accusation. All defendants are presumed innocent unless and until proven guilty.
