Child neglect case headed to grand jury

ELKINS — The case against a Randolph County woman accused of child neglect is headed for the grand jury after she waived her right to a preliminary hearing on Tuesday.

Meagan Yvonne Cedillo, 33, appeared in Randolph County Magistrate Court Tuesday morning with her attorney, Les Mallow. Cedillo is charged with gross neglect of a child creating a substantial risk of death or serious bodily injury, a felony. She is currently being held at the Tygart Valley Regional Jail on a $50,000 cash-only bond.

After Cedillo waived her right to a preliminary hearing, Mallow asked Randolph County Magistrate Court Judge Tracy Harper to modify and/or reduce Cedillo’s bond to a $35,000 personal recognizance (P.R.) bond and a $15,000 real property bond with a bail bondsman or a surety component. Mallow added that Cedillo was amenable to home confinement.

Mallow, in his argument, said that Cedillo’s bond should be modified due to her having no prior criminal history, having no history of flight or failure to appear and having an indigent status.

“From her perspective, (it) raises significant statutory and constitutional law concerns of violating her rights,” Mallow told the court.

“While this court knows (Cedillo) has no entitlement or no right to bail, she has a right from excessive bail.”

Mallow also said that, upon information and belief, there was “no direct, personal violence alleged on the alleged victim.”

Assistant Randolph County Prosecutor Leckta Poling said the state would leave the decision on bond modification to the court’s discretion.

After a moment of consideration, Harper denied the request for a bond modification and/or reduction.
