BUCKHANNON -- An Upshur County man faces a felony and two misdemeanor charges after allegedly threatening to kill a romantic partner and a neighbor, and obstructing police.
David James Sizemore, 31, is charged with third-offense domestic assault, a felony, and assault and obstructing an officer, both misdemeanors. He is currently being held at Tygart Valley Regional Jail on a $15,000 cash-only bond for the felony and a $3,000 cash-only bond for the misdemeanors.
According to the criminal complaint, filed by Deputy R.T. Lamb with the Upshur County Sheriff's Office, on May 10, Lamb responded to a residence for a reported domestic violence at 12:02 a.m. Upon speaking to the neighbor, who made the initial 911 call, Lamb learned that a male suspect, who was in the home with an infant child, was possibly "under the influence of alcohol or controlled substances."
A search of the residence found a five-month-old child in a back bedroom, with the male suspect believed to have fled out the back door of the home, according to the complaint.
Lamb writes that he then spoke with the alleged victim, who told him she had arrived home with Sizemore and two children, when Sizemore "became irate about the victim's contact with her mother regarding the defendant's past criminal history."
The alleged victim reportely told Lamb that Sizemore stated "he would f***ing kill us" and proceeded to punch the wall between the living room, where the alleged victim was, and the kitchen, where Sizemore was.
The alleged victim told Lamb that, in fear for her and her child's safety, she collected her four-year-old daughter and immediately left the residence, according to the complaint.
Lamb writes that he observed damage to the wall of the kitchen area, "which appeared to have been caused by a fist." Law enforcement officers were unable to make contact with Sizemore for more than an hour while on the scene.
In a second criminal complaint filed by Lamb, another call was made to 911 around 1:58 a.m. that same night, reporting another incident of domestic violence involving Sizemore, who had returned to the residence.
911 was advised that Sizemore was making threats against a neighbor while brandishing a knife. Sizemore allegedly threatened to kill the neighbor "for helping the original domestic violence victim," according to the complaint.
When Lamb arrived on the scene, the neighbor advised him that he had been standing outside in an attempt to see if Sizemore had returned to the scene, the complaint states.
Sizemore then allegedly exited the residence and began to approach the neighbor, who retreated towards his own home.
The neighbor told Lamb that Sizemore allegedly repeatedly stated, "I'll kill you" while having his fists clenched. The neighbor said Sizemore's actions put him in fear for his safety, according to the complaint.
Lamb, after being advised that Sizemore was back in the residence, attempted to make contact with him, the complaint states.
Lamb found Sizemore in the hallway of the residence; however, Lamb writes that Sizemore defied lawful commands and "took his hand off the wall and placed it into his pocket" out of Lamb's sight.
Sizemore also continued to look in Lamb's direction despite being repeatedly told to look away from officers, the complaint states. Lamb then took Sizemore into custody.
