44 indicted by Upshur grand jury

BUCKHANNON — Forty-four individuals were named in indictments by an Upshur County grand jury Tuesday, on charges including attempted murder, terroristic threats and malicious assault.

Jocelyn Marie Krum, 28, of Cross Lanes, was indicted for attempted murder, wanton endangerment, two counts of burglary, use or presentation of a firearm during the commission of a felony and prohibited person in possession of a firearm, all felonies.

Krum is accused of entering a man’s home and firing a rifle at him in June.

According to the criminal complaint, the alleged victim said he had been watching television when he heard his door open and saw Krum “holding a rifle to his head.” The alleged victim said Krum didn’t say anything and went back outside, but then returned, saying she was “going to kill (the alleged victim)” and fired a shot in his direction. The alleged victim said he then proceeded to chase Krum out of his home.Rayne Prince Marion Chuma, 22, of Powder Springs, Georgia, was indicted for attempted murder and attempted malicious assault, both felonies; and destruction of property, a misdemeanor.

In a separate indictment, Chuma was indicted for two counts of attempted malicious assault, a felony, two counts; and wanton endangerment involving explosive material, a felony, two counts.

Chuma is accused of attempting to strike a man with his vehicle at the Buckhannon Walmart.

According to the criminal complaint, Chuma drove his vehicle “rapidly” at the alleged victim “in an attempt to strike him” in the stores’ parking lot. The alleged victim attempted to jump “over the car” to avoid being hit, the complaint states, and had marks on his knees from where he struck the pavement. Chuma also allegedly hit an outer wall at Walmart with his vehicle, “causing damage” to the building.

Matthew Eli Whitehead, 28, of Belington, was indicted for driving while in an impaired state and proximately causing the death of another person, and driving while in an impaired state and causing serious bodily injury to another person, both felonies; and driving while in an impaired state, a misdemeanor.

Randall Gene Bender Jr., 44, of Buckhannon, was indicted for two counts of failure to provide notice of a change to required sex offender registration information, life registrant-second offense, and failure to report to verify required sex offender registration information, life registrant-second offense, both felonies.

Anastasia Evelyn Kendall, 22, of Buckhannon, was indicted for six counts of falsifying accounts, a felony.

Jared Nolan Bryant, 21, of Buckhannon, was indicted for two counts of computer fraud, and two counts of unlawful use of an access device, all felonies.

Charles Dale Clemens, 75, of French Creek, was indicted for two counts of sexual abuse of a child by parent, guardian, custodian, or person in a position of trust, and two counts of sexual abuse in the first degree, all felonies.

James Olen Murphy Jr., 64, of Bridgeport, was indicted for fleeing in a vehicle with reckless indifference to the safety of others, a felony; and attempt to flee by means other than the use of a vehicle, and obstructing an officer, both misdemeanors.

Joshua Small II, 42, of Buckhannon, West Virginia, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony, one count.

Brandi Dawn Martin, 39, of Buckhannon, was indicted for gross child neglect creating substantial risk of death or serious bodily injury, a felony.

Michael Craig Courtney, 41, of Buckhannon, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony.

Alan Lee Stanley, 45, of Buckhannon, was indicted for possession of a controlled narcotic substance with the intent to deliver, fentanyl/xylazine, and delivery of a controlled narcotic substance, fentanyl/xylazine, all felonies.

Alan Lee Stanley, 45, of Buckhannon was indicted for two counts of malicious assault, one count of suffocation, and 29 counts of sexual servitude of an adult, all felonies.

Christian Lee Lyons, 48, of Charleston, was indicted for uttering, a felony.

James Anderson Roy, 59, of Rock Cave, was indicted for three counts of failure to provide notice of a change to required sex offender registration information, life registrant, second or subsequent offense, a felony.

Gione De Jesus Azevedo, 37, of Newark, New Jersey; Joao Batista Da Fonseca, 45, of Newark, New Jersey; and Bruno Martins Ferreira, 34, of Newark, New Jersey, were each indicted for robbery in the first degree, and conspiracy to commit a felony crime of violence against a person, all felonies.

James Robert Arbogast, 53, of French Creek, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony.

David Michael Leggett, 42, of Orlando, West Virginia, was indicted for possession of a controlled narcotic substance with the intent to deliver, fentanyl; possession of a controlled narcotic substance with the intent to deliver, fentanyl/xylazine; possession of a controlled substance with the intent to deliver, methamphetamine; and prohibited person in possession of a concealed firearm, all felonies; and possession of a controlled substance, marijuana; possession of a controlled substance, alprazolam; possession of a controlled substance, clonazepam; two counts of prohibited person in possession of a firearm; and one count of reckless driving, all misdemeanors.

Tiffany Dawn Sparks, 44, of Buckhannon, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony.

Andrew Devon Hitt, 25, of Buckhannon, was indicted for two counts of threats of terroristic acts, a felony.

Randall William Osburn, 65, of Buckhannon, was indicted for six counts of failure to provide notice of a change to required sex offender registration information, life registrant-second offense, a felony.

James Anderson Roy, 59, of Rock Cave, was indicted for two counts of prohibited person in possession of a firearm, a felony.

In a separate indictment, Roy was also indicted for grand larceny and conspiracy, both felonies.

Michael Paul Wilkins, 48, of Buckhannon, was indicted for criminal diversion of medical cannabis by a patient, a felony.

Adam Scott Heater, 31, of Buckhannon, was indicted for two counts of being a prohibited person in possession of a firearm, a felony.

William Arthur Large, 56, of Buckhannon, was indicted for prohibited person in possession of a concealed firearm, a felony; and for prohibited person in possession of a firearm, and possession of a controlled substance, methamphetamine, both misdemeanors.

Briton Eugene Herron, 18, of Buckhannon, was indicted for possession of counterfeit bank notes with intent to utter, and prohibited person in possession of a concealed firearm, both felonies; and prohibited person in possession of a firearm, driving while in an impaired state, reckless driving, and no insurance, all misdemeanors.

Joshua Dale Cutright, 36, of Horner, and Katelynn Marie Wine, 26, of Buckhannon, were indicted for delivery of a controlled substance within 1,000 feet of a school, fentanyl, and conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, both felonies.

Kelly Dawn Harvey, 41, of Buckhannon, and Willie Junior DeBarr Jr., 36, of Buckhannon, were indicted for delivery of a controlled substance within 1,000 feet of a school, fentanyl; conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code; and delivery of a controlled substance, fentanyl, all felonies.

Sara Jo Loudin, 34, of Buckhannon, was indicted for three counts of delivery of a controlled narcotic substance, buprenorphine, all felonies.

Kevin Donald Casto, 46, of Buckhannon, was indicted for three counts of delivery of a controlled narcotic substance, fentanyl, a felony.

Kiley Ann Parson, 46, of Buckhannon, was indicted for delivery of a controlled substance within 1,000 feet of a school, methamphetamine, a felony.

Damond Ersel Phillips, 44, of Montrose, was indicted for fleeing in a vehicle with reckless indifference to the safety of others; and forgery of a title or registration, all felonies; and driving while license revoked for DUI, and no insurance, both misdemeanors.

Joe Allen Ball, 61, of Buckhannon, was indicted for six counts of wanton endangerment involving a firearm, a felony; and obstructing an officer, and six counts of shooting within 500 feet of a dwelling, both misdemeanors.

David Christopher Perrine, 36, of Rock Cave, was indicted for domestic violence, third or subsequent offense, a felony; and brandishing a deadly weapon, a misdemeanor.

Joshua Layne Schoolcraft, 20, of Buckhannon, and Dakota Paul Alderman, 19, of Buckhannon, were indicted for attempted grand larceny, and conspiracy, all felonies; and fleeing by means other than the use of a vehicle, a misdemeanor.

Warren Harry McCarthy, 19, of Buckhannon, was indicted for two counts of sexual assault in the first degree, and one count of sexual abuse in the first degree, all felonies.

Franklin Lee Tefft, 49, of Buckhannon, and Lindsay Jo Chapman, 43, of Buckhannon, were indicted for possession of a controlled substance with the intent to deliver, methamphetamine; and conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, all felonies; and prohibited person in possession of a firearm, a misdemeanor.

James Carroll Tenney, 43, of Buckhannon, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony.

Ervin William Hinkle, 41, of Rock Cave, was indicted for possession of a controlled substance with the intent to deliver, methamphetamine; conspiracy to violate Chapter 60A, Article 4, Section 401 of the W. Va. Code, all felonies; and possession of a controlled substance, marijuana, a misdemeanor.

A press release from Upshur County Prosecuting Attorney Bryan Hinkle’s office points out that an indictment is merely an accusation, and all defendants are presumed innocent unless and until proven guilty.
