ROCK CREEK -- An Upshur County man faces six felony charges after allegedly possessing multiple firearms despite being prohibited from doing so.
Phillip Roy Ogden, 38 is charged with six counts of persons prohibited from possessing firearms, a felony. He was being held on a $30,000 property/surety bond that has since been posted.
According to the criminal complaint, filed by Deputy R.T. Lamb with the Upshur County Sheriff's Office, on March 12, Lamb attempted to execute multiple forthwith arrest warrants on Ogden, who was known to reside in Rock Cave.
While attempting to locate Ogden, Lamb observed a New England Firearms .410 gauge sawed-off shotgun lying in plain view in the backseat of a vehicle belonging to Odgen, the complaint states.
Another vehicle that "appeared to be driven by Ogden" was found parked nearby with a blue digital scale covered in a "clear crystal-like residue," the complaint states. It is suspected that the residue was methamphetamine. Lamb and another officer observed what they believed to be Ogden's work clothes inside this second vehicle.
On March 14, a search warrant was obtained and executed for the residence in Rock Cave, which "appeared to no longer be Ogden's residence," the complaint states. An acquaintance of Ogden's advised police that the vehicle that the .410 gauge sawed-off shotgun was found in had been recently purchased by Ogden from a work colleague. Ogden's brother later told police where Ogden now resided.
On March 20, a search warrant was obtained and executed at a residence where Ogden was confirmed to be living, the complaint states.
According to the complaint, the following items were allegedly located in Ogden's bedroom closet, "within arm's reach of his bed":
∫ One .45 Auto Kimber 1911 semi-automatic handgun with three loaded magazines;
∫ Two Marlin semi-automatic .22 caliber rifles;
∫ One Savage Mark I .22 caliber rifle;
∫ One K.S.A Cricket .22 caliber rifle;
∫ Numerous unfired rifle and pistol cartridges.
Ogden allegedly advised officers that he was aware of the .410 gauge sawed-off shotgun that was found in his vehicle and claimed he had "allowed an acquaintance to leave it inside the pickup truck and moved it (himself) on at least one occasion," the complaint states.
Ogden also allegedly admitted to officers that he was aware of "at least one" .22 caliber rifle inside the closet of his bedroom.
According to the criminal complaint, Ogden is a "known drug user" and a convicted felon with a felony conviction for breaking and entering in 2017 and a felony conviction for intent to deliver methamphetamine in 2022.
