Man charged after wrecking a motorcycle

BUCKHANNON — An Upshur County man faces two felony charges after a motorcycle crash revealed he allegedly was operating a vehicle with a revoked license and an altered registration.

Harley David King, 47, is charged with one count of third-offense driving while license revoked for DUI, and one count of having a fraudulent registration plate, both felonies. King is currently being held at the Tygart Valley Regional Jail on a $30,000 surety/cash bond.

According to the criminal complaint, filed by Cpl. T.R. Collins with the Upshur County Sheriff’s Office, on Oct. 11, Collins observed a male driver wreck a motorcycle at the Mt. Nebo and Route 33 West intersection in Buckhannon.

Collins pulled his patrol vehicle behind the motorcycle and made contact with the driver, who was identified as King, the complaint states. Collin allegedly observed a West Virginia registration plate that allegedly had been altered “by scraping the year sticker off” and painting a different sticker on the plate to make the registration look valid.

King told Collins he had crashed because he lost control while attempting to turn around on the roadway, the complaint states. King allegedly admitted to Collins that he did not possess a valid driver’s license.

After Collins detained King, he ran his and the motorcycle’s information through the Upshur Communication Center, the complaint states. Collins was advised that King’s license was currently revoked for DUI, and the registration plate on the motorcycle had been terminated in 2016.

According to the complaint, King allegedly has prior convictions for driving while license revoked for DUI from 2015 and 2018. Collins writes that King was previously arrested for third-offense driving while license revoked for DUI on Oct. 7, and that King was on bond for the same charge from a previous arrest on May 25.

A preliminary hearing for King has been scheduled for Oct. 20 in Upshur County Magistrate Court.
