Buckhannon pair facing felony charges

BUCKHANNON — A man and a woman were arrested in Upshur County after being found in possession of a vehicle stolen from Harrison County in October, while the man also faces a felony charge for allegedly obtaining money under false pretenses.

Joshua Small II, 43, and Breanna Lee Poling, 29, are both charged with one count of receiving or transferring a stolen vehicle, a felony. Small is also charged with one count of obtaining money, property and services by false pretenses, also a felony.

Smalls is currently being held at the Tygart Valley Regional Jail on two separate $10,000 surety/cash bonds. Poling is also being held at the Tygart Valley Regional Jail on a $10,000 surety/cash bond.

According to the criminal complaint filed by Patrolman Cole Bender with the Buckhannon City Police Department, on Nov. 3, Bender received a direct complaint about Small from a Buckhannon resident.

Upon arrival, Bender was told by the alleged victim that, on Sept. 20, Small had come to the residence seeking work, the complaint states. The alleged victim said he told Small he wanted Small to do work on the front porch of the residence; however, Small allegedly stated that he would “need money to do so.”

The alleged victim told Bender that he wrote Small a check for $1,000 with the memo “Deck Labor,” which Small allegedly cashed on Sept. 22, the complaint states. Bender writes that, as of the date the criminal complaint was filed, the agreed upon work “has not been completed.” The alleged victim reportedly asked for his money back; however, Small failed to return the $1,000.

According to the criminal complaints filed by Patrolman Dylan Ray Major with the Buckhannon City Police Department, on Nov. 16, Major, Sgt. T. Posey and Sgt. D. Hissam received a notice from the Upshur Communications Center regarding a positive hit on a stolen vehicle from Harrison County through a license plate reader within Buckhannon city limits. The vehicle had been stolen from a Harrison County resident on Oct. 13.

The officers located the vehicle at the McDonald’s in Buckhannon with two occupants inside, the complaint states. The driver of the vehicle was identified as Poling and the passenger was identified as Small. When Major confronted both Poling and Small about the vehicle being stolen, both allegedly claimed that they had a bill of sale for the vehicle, but no bill of sale was ever provided.

The Upshur Communications Center reaffirmed that the vehicle was a positive hit through the National Crime Information Center for the vehicle stolen from Harrison County on Oct. 13, the complaint states. Major writes in Small’s complaint that Small also had an active warrant in Harrison County for the stolen vehicle.

According to jail and magistrate court records, Small is also being held at the Tygart Valley Regional Jail on a $10,000 surety/cash bond and a $1,000 PR bond for two recent charges in Harrison County.

On Oct. 27, Small was charged with misdemeanor obtaining money, goods or other property by false pretenses in Harrison County.

He was also charged in Harrison County with one count of felony obtaining money, goods or other property by false pretenses on Nov. 14.
