Randolph County man facing felony driving charge

HUTTONSVILLE — A Randolph County man is facing a felony charge after allegedly driving with a revoked license for the third time.

Homer Clark Goldsmith, 57, is charged with third offense driving with license revoked, a felony. He is currently being held at the Tygart Valley Regional Jail on a $5,000 cash-only bond set by Randolph County Magistrate Benjamin Shepler.

According to the criminal complaint filed by Trooper H.J. Bonetti with the West Virginia State Police, on Nov. 8, Bonetti observed a running vehicle parked near the roadway in front of Anderson’s Tire and Auto in Huttonsville. As Bonetti got closer to the vehicle, he observed that the keys were in the ignition, the lights were on and Goldsmith was “slumped over the center console.”

Bonetti knocked on the vehicle’s window, however Goldsmith did not respond which prompted Bonetti to request EMS, the complaint states. Bonetti then broke the rear passenger window to make contact with Goldsmith, who advised Bonetti that he did not need EMS.

Goldsmith allegedly told Bonetti that he was waiting for Anderson’s Tire and Auto to open on Sunday so he could get work done on the vehicle, the complaint states. Bonetti notes in the complaint that Anderson’s is not open on Sunday. Bonetti asked Goldsmith if he had driven the vehicle to Anderson’s, to which Goldsmith allegedly said that the vehicle had been towed there, but he did not know the name of the towing company.

Bonetti asked the question again, to which Goldsmith allegedly said this time that someone else had driven the car to Anderson’s on Friday, the complaint states. Goldsmith allegedly did not know this other person’s name. Bonetti countered that he saw Goldsmith near the Goodwill in Elkins on Saturday morning. Goldsmith allegedly explained that he had been driven to Anderson’s on Saturday evening by another person he did not know the name of.

According to the complaint, Bonetti requested the video surveillance footage from Anderson’s. The footage allegedly shows the vehicle “running and parked” outside of Anderson’s around 7:34 p.m. on Saturday. Bonetti writes that he did not observe any tow trucks or other people on the footage.

Bonetti ran Goldsmith’s name through the Elkins West Virginia State Police Communications and was informed that Goldsmith had two prior driving with license revoked convictions, with one in 2011 and another in 1987.
